Illinois becomes 1st state to abolish cash bail as Pre-Trial Fairness Act takes effect

CHICAGO (WLS) -- The Pre-Trial Fairness Act, part of the SAFE-T Act that eliminates cash bail, goes into effect Monday morning.

Many local elected officials plan to celebrate the elimination of cash bail which takes effect Monday after extensive delays and legal challenges from some prosecutors and law enforcement leaders who sought to keep the existing system in place.

Under the existing system, a judge can set bail as a means of ensuring the defendant will show up for court hearings.

However, starting Monday, that will no longer be the case.

If a judge decides a defendant does not pose a public safety or flight risk, they will be released without being required to post any money.

People arrested for violent crimes will likely be detained by a judge.

"Ideally, what this will cause is a more careful, a more thorough consideration of the risk posed by defendants of the likelihood the defendant will appear when he or she is supposed to appear," ABC7 Political Analyst Gil Soffer said.

Advocates for the Pre-Trial Fairness Act sid the previous system punished people for being poor and caused tens of thousands of people to lose their jobs, housing and even custody of their children because they couldn't afford to pay bond.

I am convinced that the dumbest laws in Illinois are being passed under intense lobbying pressure from the Indiana and Iowa Chambers of Commerce.

under direct tutelage of California “lawmakers”

It more or less enlists a private police force (bail bondsmen) to ensure that the defendants show up.

~~~~~~~~~~~~~~~~~~~
Illinois doesn’t have bail bondsmen. Defendant puts up 10% of the set bail, in cash. *I speak from experience.
And if you don't have that 10% you go to a bail bondsman, put up your mother's house as collateral, and the bail bondsman pays the 10%.
There's dozens of bail bondsmen in Chicago alone.
Agreed.
I wonder if that city councilwoman in Minneapolis learned her lesson?
“People arrested for violent crimes will likely be detained by a judge.” If only that were the case. Everywhere this has been implemented they have let violent offenders free.
From the link you provided:
Since there are no bail bondsmen in Illinois, those arrested can post bail directly to the court. This means they must pay the bail to the clerk of the court that will hear their case. Depending on which court, the procedure for posting bail may differ.
This will drive the bail bondsman out of business. So those who have bail set, will have nowhere to turn for bail money.
It sounds like the Illinois “Justus” system doesn’t GAS if you show up for court or not. Lawlessness is the new rule in this country.
There is an ulterior motive here. If you don't show, you get a bench warrant out for your arrest.
Youtube has several lines of videos that feature cops stopping people for traffic violations and then discovering that the driver or passenger has a bench warrant. The results are often a struggle to arrest the subject and a colorful display of sociopathy. 'No bail' ensures that this line of videos will continue to be in plentiful supply.
There you go. And it helps to keep “On Patrol Live” on the air. Every idiot they stop is either smoking dope or has a warrant.
