New Hampshire Lawmakers: ‘No Legal Basis’ to Remove Trump from Ballot

Top New Hampshire politicians, including the speaker of the State House and State Senate president, sent a letter Tuesday to Secretary of State David Scanlan stating “there is no legal basis” to remove former President Donald Trump from the 2024 ballot using the Fourteenth Amendment, as anti-Trump legal scholars have suggested.

Senate President Jeb Bradley (R), New Hampshire House Speaker Sherman Packard (R), and former U.S. Sen. Bob Smith (R) headline the dozens of New Hampshire officials, including state senators, representatives, and executives, who signed the letter, which the Trump campaign shared via an emailed press release.

“President Donald J. Trump is once again at the forefront of political attacks, this time by those who are attempting to disqualify the former President from appearing on New Hampshire’s primary ballot by weaponizing Section Three of the Fourteenth Amendment against him,” the letter begins.

It continues:

Since 1920, New Hampshire has been a state that prides itself on being the First-in-the-Nation to hold their primary elections and setting the stage for the rest of the country. But that status is now in jeopardy because of an absurd conspiracy theory to deny President Trump, the current front-runner in New Hampshire, from being on the ballot.

There is no legal basis for these claims to hold up in any legitimate court of law. The opinions of those perpetuating this fraud against the will of the people are nothing more than a blatant attempt to affront democracy and disenfranchise all voters and the former President. These individuals who are seeking to deny voters access to support their candidate of choice are nothing more than political pawns of the Left doing their bidding, which is disappointing since the Democrat Party has continually tried to strip New Hampshire of its First-in-the-Nation status.

SECTION 3 of the 14th Amendment DOES NOT APPLY TO THE PRESIDENT.

The President is NOT one of the positions explicitly mentioned in the text (Senators, Representatives, Electors). Was this some sort of oversight on the part of the authors of the 14th ??? You would think that mentioning the President would be front and center in this section if it was applicable. And why be concerned about “ELECTORS OF THE PRESIDENT” ???? If an insurrectionist running for President could be disqualified, his Electors would be fairly irrelevant at that point but yet they are one of only three positions specifically mentioned.

What about the next part that addresses “any office under the United States” ? Well that won’t work either since the President is not considered an office UNDER the United States, it is the Chief Executive OF the United States. In 1878 David McKnight authored his study of the Electoral System of the United States and in that work he came to the conclusion that the President is “obviously not” an office under the United States. Being that he wrote this just 12 years after the 14th Amendment was passed, and his view has not been challenged for over 100 years, it is pretty reasonable to assume his view represents the basic civic thinking of the time much more so than partisan thinking interprets Section 3 today.

I don’t like Governor deSanctis’ bid for the presidency in this cycle. I think it’s both disloyal and ill-advised. But he is not the one asking for this, and I don’t believe he would stoop that low.

He’s done an excellent job as governor in many respects, especially with regard to the Covid hysteria and fixing the schools and putting a leash on the Mouse, and in the right time, say 2028, he might take another stab at the top slot, although probably without Trump’s blessing.

Let’s remember Reagan’s dictum about the Big Tent. Unfortunately, there are some RINOs who cannot be allowed to remain under it any more. But deSanctis is not one of them. Pence is. Mittens is.

I think DeSantis needs to stay just where he is and continue to be a huge thorn in the side of the left, and to set the standard for other governors to follow.

I don’t think he could accomplish much as president without the support of the House and Senate. As governor, he has far more influence and and ability to act.

I hope he has a long and successful career as governor of FL. He’s doing a great job.

A move to the WH might be in the future for him, but not next year. As you say, he’s too important in Florida.
