Judges in California may have to consider a parent's affirmation of their child's identity in custody cases

California lawmakers on Friday passed a proposed law that would require judges in the state to consider a parent's acceptance or affirmation of their child's gender identity when weighing child custody disputes.

The Assembly approved the measure and sent it to the governor's desk on a party-line vote of 57-16, with a handful of Democrats not voting...

Republicans argued judges in California already have the discretion to consider this factor in custody cases and noted the term "affirmation" is not defined in the proposed law.

"This trans conversation is very complicated and delicate, I do think there are parents who have different viewpoints," said Assemblyman Bill Essayli, R-Riverside. "Especially young children who don’t know who they are. I think parents have to be given the space to go on that journey with their child."

Gov. Gavin Newsom has until Oct. 14 to sign or veto the bill.

Okay so the bill to allow parental rights to be removed if they don't "affirm" a child's identity has passed the California Legislature and headed to Governor Newsom's desk.

He is expected to sign it into law.

If you live in California and you are a parent I hope you can get out.

My brother and sister-in-law are. Off to Oklahoma for them.

Don’t worry Sooners, they are conservative, even if both are immigrants. (Trad Catholic)

Law says that judges must "weigh" it as "a factor."

In theory, the judge can still decide that in any particular case, the merits of the "non-affirming" parent still outweighs the merits of the "affirming" parent.

But I don't suppose that will ever happen.

With legislators like that, who needs judges?

Are we yet at the point where we should start giving the "courts" the respect they are due?
