New York and the Republicans won, here in Florida this ruling could be overturned because DeSantis has remade the Florida Supreme Court into a solid conservative majority which will have a say on this matter

The state Supreme Court will fix this.

“The Constitution says they get one bite at that apple per decade, and that’s what SCOTUS should rule. Once an election is held against the new districts, they must remain in place until the next census and reapportionment.”

That’s not the law. The Constitution says that there must be a reapportionment after each census, but it doesn’t prohibit additional “intercensus” reapportionments.

How do I know? Because the Republicans in Texas pioneered this technique. After the 2000 census, new Congressional districts were used in the 2002 election. In the 2002 state elections, however, the Republicans gained control of state government. They then redrew the lines to be much more favorable to the GOP. The new lines were used in the 2004 elections. The Texas Congressional delegation went from 17D-15R to 21R-11D.

And SCOTUS said that was permissible.

You are confusing reapportionment with delimitation and redistricting.

States do not reapportion their House seats. The Federal government, via the census, reapportions the seats amongst the states. That just determines how many seats each state gets. That is mandated every ten years by the Constitution and can not be changed in between.

However the process for delimitation and drawing of congressional districts is strictly left to the states and not tied to the ten year cycle. If a state gains or loses representatives after a census, they of course are required to redistrict. But they may do so at any time.

Called this more than a year ago here:

Redistricting 2022: Winners and Losers (scroll down to Florida)

And reminded people what happened less than a decade ago when Democrats sued in Florida -- and of course won. The FL Supreme Court does in fact have several new DeSantis-appointed members since it caved to the Rats in 2015, but we shall see (hopefully) if the Court has been sufficiently "remade" or not. Even in 2015 it was 100% Republican -- but majority liberal.

As to post 21, regarding possible GOP lawsuits elsewhere:

New York and the Republicans won, here in Florida this ruling could be overturned because DeSantis has remade the Florida Supreme Court into a solid conservative majority which will have a say on this matter

A Republican judge DID get the ridiculous Democrat gerrymander in New York overturned back in 2022, which aided them greatly in their series of fluke wins, but that's ancient history.

Now the Democrats have sued in New York, and WON. Santos was already toast no matter what, and now probably 3 or 4 (if not more) of his GOP colleagues will be ousted too in 2024.

As to post 13 with all the pretty maps, the most important one is totally wrong. Al Lawson's district no longer exists as shown, and neither does Al Lawson (who is no longer employed), though he may still be the poster boy for this suit.

As I also pointed out over a year ago, this crap isn't really about protecting "minorities" despite all the Democrat whining, and a nice example can be found in New Mexico. That is where the Democrats obliterated a "minority" district -- without a peep -- since that minority was a REPUBLICAN.

When it comes to Democrats, there is no easy day, its political warfare, 24/7/365 on all fronts.

You mentioned in New Mexico the Democrats eliminated a Republican Minority district, did the Republicans sue over that and if not, why not, could the reason be Republican took the loss and went home to cry.

I feel good about the Florida, they have upheld a couple of DeSantis actions recently, we’ll see but I have hope in that case.

Apparently the Republicans did sue in New Mexico back in January of 2022, a couple of weeks after the Democrats implemented their gerrymander.

I haven’t found any link to the outcome, but seeing as how the Rat districts were used 10 months after the suit was brought and are still in line to be used 2 years after THAT, I think we can guess how it went.

You are certainly correct about how nowadays the battle over redistricting never ends — until the Democrats get what they want.

In 2024 we’re going to (or very likely will) see new Democrat-friendly maps in:

Alabama (+1 Rat seat in the House)
South Carolina (+1)
Louisiana (+1)
New York (+3 to 5, probably)
Ohio (unknown impact yet, but +something)
Florida (Rats aren’t going to settle for just +1)
Tennessee (+1)
Wisconsin (+2 and they may go for +3)
Georgia (+1 minimum)

Perhaps others. These aren’t ALL (hopefully) going to happen, but don’t be surprised if they do.

As it stands now the one place where the GOP can fight back is in North Carolina, where Democrats illegally seized control of the last redistricting. The Republicans could pick up a seat or 2 there if they ever get around to trying.... at least until the Rats sue (and win) against whatever plan the NCGOP creates.

My district. I would lose my wonderful Rep. Kat Cammack. The newly drawn districts are very regularly shaped so I think this decision will be overruled by the Florida Supreme Court.

So Black voters are somehow special enough to deserve their very own candidate (while the other demos aren’t)?

OK, then, let’s have Byron Donalds run in the new district in 2024. Let’s see how that sits.

The Florida GOP had their own map ready. DeSantis insisted on getting rid of the majority-minority district and he won.

In Florida, the GOPee rolls over for Conservatives, apparently.

Seems Judge Marsh is the culprit of the supremes appointed by Rick Scott. Why Scott appointed him I will never know. And, I’m a huge Rick Scott fan. But once again none of these guys are 100%. They keep proving it over and over.

https://news.yahoo.com/florida-judge-strikes-down-desantis-180136436.html?fr=yhssrp_catchall

A state judge on Saturday rejected congressional district boundaries affecting communities across North Florida, saying they unconstitutionally restrict Black voting power and that Florida’s Legislature must redraw them.

“By dismantling a congressional district that enabled Black voters to elect their candidates of choice under the previous plan, the enacted plan violates … the Florida Constitution,” Circuit Judge J. Lee Marsh in Tallahassee ruled.

In the 55-page ruling, he also noted that throughout history “Florida has been a state home to discrimination in voting.”

Marsh barred state officials from holding elections that use the current boundaries developed to replace the former Congressional District 5, whose seat was held by former U.S. Rep. Al Lawson.
