But New Hampshire is also looking into potentially barring Trump from the ballot during their primary. They haven’t established an official position on the subject, but they’re seeking legal advice, citing the shoddy 14th Amendment argument, which some legal scholars say disqualifies Trump from being president over January 6 (via Boston Globe):
A debate among constitutional scholars over former president Donald Trump’s eligibility for the 2024 presidential race has reverberated through the public consciousness in recent weeks and reached the ears of New Hampshire’s top election official.
Secretary of State David Scanlan, who will oversee the first-in-the-nation presidential primary in just five months, said he’s received several letters lately that urge him to take action based on a legal theory that claims the Constitution empowers him to block Trump from the ballot.
Scanlan, a Republican, said he’s listening and will seek legal advice to ensure that his team thoroughly understands the arguments at play.
[…]
A spokesperson for the New Hampshire Department of Justice said the attorney general hasn’t taken a position on these matters but will review the relevant legal issues and provide guidance as Scanlan requested.
Why are you doing this, New Hampshire? It’s a crock legal theory; a non-lawyer could see this opinion as anti-Trump garbage. It relates to Section III of the 14th Amendment, which disqualifies persons from public office if they have engaged in rebellion or insurrection. Oh, and these folks say a conviction isn't required to enforce this measure. So, due process can be applied in some areas and not others—isn’t that the definition of unconstitutional? Law professor Jonathan Turley took a blowtorch to this argument:

Trump and MAGA are the last obstacle to a communist take over of the government. No Trumpers are Vichy Republican traitors.
In a Trump-Sununu challenge in New Hampshire, Trump would win by a least 20 points imho.
Are you from Florida?
I think the word “qualified” is key. It means that a candidate for Senate must be 30 before he takes office, President must be born in the U.S. and be 35, etc. Some might maintain that the 14th Amendment “disqualifies” Trump, but that is sheer fantasy, on its best day.
What happened to “let the people decide”?
What happened to “We must save democracy”?
Forcing Trump off the ballot is a direct assault on Democracy and delegetimizes the 2024 election.
Why doesn’t the RINOS let the people decide.
“Someone please make sense of this:
In New Hampshire, a person whose name was not printed on the official state primary election ballot of a political party shall not be entitled to the nomination of that party for any office unless the person received at least 35 write-in votes or write-in votes equaling 10 percent or more of the total votes cast for that party on the state primary election ballot, whichever is smaller. If a person is disqualified from a nomination in accordance with the provisions of paragraph I, then the nomination shall be awarded to the qualified person who received the highest number of votes, provided that person received at least 35 votes or votes equaling 10 percent or more of the total votes cast for that party on the state primary election ballot, whichever is smaller1.”
Well in my opinion, this would apply only to state offices, since a presidential primary is not for a state office but for choosing delegates to a party convention.
.
Anyone else notice the irony in Republicans preparing to challenge the Constitution to keep the power system as it is, but in 2020 the Constitution was above challenge for defending election integrity.

It’s “whatever argument we need to make at the time” to achieve our preferred ends. It’s how people in power operate.
The Issue is never the issue, The Issue is always The Revolution.
listless vessel
It becomes more obvious each day that DeSantis is barely Republican.
Can you imagine the butthurt if they keep Trump off the ballot and he wins by write-in?
FAFO!
We have family in Florida.
The state was also where we were looking at property in preparation for moving from NYS.
That’s why we’ve followed its politics and its budgets.
We’ve now canceled any ideas of a move.
We’ve come to the conclusion that we’re not voting-with-our-feet our way our of this.
There’s no longer a truly red state in this nation.
If you don’t believe me, look at the budgets.
Deep State had every state in this nation by its budgetary short hairs.
Got it. Thank you.
You’re welcome.
And I meant to say Deep State HAS every state by its budgetary shorthairs.
And if the outyears are anything to go by, will for the foreseeable future.
I notice Trump got a new lawyer to represent him in Georgia.

Possibly this guy won’t be a pathetic loser like all the other lawyers foisted on Trump in the past.
And, on the slight, almost negligible chance that Trump has finally figured out how to hire non-pathetic loser lawyers, Vice Presidents, cabinet secretaries, and executive staff, maybe he could get another new lawyer to represent him in New Hampshire.
But, I think I’ve come up with a real solution: Donnie Jr. should have Trump University award Donald Trump a law degree, so he can represent himself. Since Donald Trump is a winner, he will then certainly win his case. He, and all of us, will get back to winning, winning, winning.
Why didn’t somebody figure this out before J6? Not only would Donald Trump be president, but all the innocent but stupid to varying degrees co-conspirators wouldn’t be in jail or risk going to jail. Well, you know what they say. Hindsight is 20-20.
This does not sound like “protecting democracy”, it sounds just the opposite.
The Bret Baier question at the debate of supporting Trump as the nominee of the party even if he is convicted of a felony is part of the anti-Trump attacks. They are sowing seeds of doubt about the viability of Trump.
Is that real? If so, goodbye Meatball.
