I've wondered why a defendant hasn't previously brought this issue to higher Courts. It's obvious that the DOJ is being creative in twisting the law to bring charges against these defendants. Just the same as they are doing to Trump.

The main purpose the Rats'n'RINOs Syndicate engineered this made-for-the-masses "insurrection™" was to interrupt the electoral vote certification - "obstruction of an official proceeding". They didn't want any discussion in Congress of the irregular methods that the states used to arrive at their final ballot count and subsequent selection of electors. After all, it was Congress that had the "standing" to discuss all the issues of the election fraud cases that the judiciary punted on. However, by hell or high water, the Rats'n'RINOs were going to create the "emergency" situation that allowed them to gaily skip right past those discussions.

As usual with these criminals, it's projection. The Rats'n'RINOs Syndicate's behind-the-scenes backers were the one's who needed the disruption (the "obstruction"). It was they who put the whole performance-art production together, to the end of creating the emergency, the rushed session for certification, and the failure to hear any of the nation's grievances.

They project the whole thing onto their enemies (the larger half of their constituents), reward their henchmen in the media to amplify their telling of it constantly, day after day for years, but it is they who manipulated human nature to create it.

FTA-—Lang’s attorney told Newsweekthe use of the statute that the litigation is centered around could upend the cases of “hundreds of defendants.”

“The government misuse and abuse of the federal penal code in the J6 cases is shocking,” Norman Pattis said.

Lang’s legal team is arguing that the has been too broadly applied coming from a federal law that states: an individual who “corruptly alters, destroys, mutilates, or conceals a record, document” or “otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so” can be imprisoned for up to 20 years.

In the appeal to the Supreme Court, Lang’s lawyers are claiming the other side did not prove anything “corrupt” went down.

Many say the lower courts have screwed this up thanks to activist judges
