I don’t recall any of them, either before or after the election, being properly judged on the facts.

The Wood v. Raffensperger case was not unlawfully blocked from being heard. The Trump appointed judge dismissed the case because 1. The plaintiff lacked standing 2. The complaint was untimely [Doctrine of latches] 3. The plaintiff failed to set forth the requisite cognizable harm which is needed to trigger the equal protection claim. Yup. Legal garbage they use when they *DON'T* want to do their job.

Wow, you really think that standing and timeliness are garbage? So I guess that you can sue John Wilkes Booth for killing Lincoln.

Also, you just called the equal protection clause of the 14th amendment, garbage.

Finally, the Judge was appointed by Trump.

I think you’re both right. We would have heard about it here on FR.

Thanks. Do you know why the Trump Campaign wasn’t the plaintiff? They would have had standing and harm, if timely filed?

Like so much of Trump’s issues, he is plagued by poor selection of appointees and counsel.

In this particular case, absolutely. Why does justice worry about time? This is one of the things i've regarded as a flaw in the legal system for a long time.

An injury which occurred in the past is still and injury and the injured party should still be entitled to justice. This is more of that garbage court "process" crap.

And "Standing"? Who doesn't have standing in an election fraud situation? *EVERYONE* is injured.

So I guess that you can sue John Wilkes Booth for killing Lincoln.

Ignoring the stupid reductio ad absurdum.

Also, you just called the equal protection clause of the 14th amendment, garbage.

It is no secret to a lot of people that I regard the 14th as one of the *WORST* amendments ever written. It is so badly written you can drive a truck through it's loopholes, and this is not even getting into the very illegitimate manner in which it was passed.

But in this particular case, I don't see how you blame the 14th amendment. For once, it's probably innocent of this fiasco.

Finally, the Judge was appointed by Trump.

It is a testament to how sh*tty the legal system works, that it makes a difference who appointed a particular judge.

In Science, anyone can replicate a process and achieve the exact same result, but in law, it hinges very significantly on the subjective attitude of the judges.

Yes, judges appointed by Democrats are almost always sh*t, and much of the time, Judges appointed by Republicans are also sh*t.

But whether or not Trump appointed him, he was an idiot, or perhaps more likely subject to political pressure, to render this decision.

Too often are courts manipulated by political pressure, such as is the case in the Derick Chauvin trial.

Modern courts are garbage and our legal system sucks.

The main problem is a sh*tty legal system that cares more about process than it does about achieving a correct result.

The "fruit of a poisoned tree" bullsh*t comes to mind.

But recounting the same group of tainted ballots doesn’t address the issue.

Now that the Democrats are using his words to frame an insurrection narrative, President Trump is providing the details of why he believed the things that he said.

“Who was behind the “broken water pipe” fraud that sent Republican poll workers home while the Democrats continued to “count” votes?”

...

That’s a good question, and my recollection is that the “burst pipe’ or even “burst water main” as I recall it being called in the media was downgraded to just an overflowing toilet. When confronted, the election manager then claimed that that having an overflowing toilet was a health hazard, and that was why he ordered everyone to leave.

Someone did a records investigation, surprise, no city work order to unclog or repair the toilet could be found.

At that point, the media got tired of the story... or didn’t like where it was headed, so they dropped it and focused on Ruby, who became the innocent victim of those mean old Republicans.

>I don’t recall any of them, either before or after the election, being properly judged on the facts.

I don't either, but THEY'RE BACK. Or at least one, now technically split into two separate cases, is back. It was initially denied for "standing" and denied at GA Appellate Court level. But a separate, non-election case, also previously denied on similar lack of standing went on to GA SCOTUS. There that was unanimously ruled to have standing. This case was then appealed to GA SCOTUS, which ruled Dec '22 that it did indeed have standing and sent it back to GA Appellate Court. That court ruled on the now split pair of cases May '23. The GA SCOTUS standing rule allowed standing for those of the plaintiffs where were residents of Fulton, the country they were suing, but not to those plaintiffs who weren't residents there. But each of the now paired suits includes Fulton residents. Now, WITH STANDING, they are remanded to the original trial court to go to trial. I don't know if they yet have a trial date set but currently it looks like data potentially sufficient to have overturned GA election results for fraud will get a day in court.

What that trial, at this late stage, could do to overturn Biden's overall theft I don't know. But it could overturn the meme that there never was any evidence of Trump's election fraud beliefs, kneecapping Fani's fantasy charges. And overturn the meme's effect to block further inquiry in multiple other states.

I would caution anyone who thinks the USSC has any business getting involved in these election disputes.

For one thing, the Federal courts have very limited authority over STATE election proceedings.

Secondly … as a separate branch of government, the USSC should never have the power to be involved in selecting candidates for the other two branches.

Lastly … if authority over election disputes is ceded to the Federal courts, we are likely to end up with a single set of national legal standards for every aspect of voting (registration, early voting, etc.). You can be damn sure that the loosest possible standards will be adopted across the board.

all the courts think it is more important to count all the votes instead of following the law that decide whether such votes are even valid.

Every vote that was cast illegally cancels out the vote of someone who voted legally.

Either we have election laws are we don’t. It is not right that every single election judges throw out the laws the legislatures pass and count illegally cast votes. It wasn’t just in 2020, this happens in every election.
