Former President Donald Trump has been charged with alleged election-tampering in Georgia under an anti-organized crime law known as RICO — a statute once famously used to finally nail New York City’s “Teflon Don” John Gotti, the late head of the Gambino crime family.
The federal RICO — or Racketeer Influenced and Corrupt Organizations — Act was adopted in 1970 and since then states, like Georgia, have gone on to pass their own version of the law.
More sweeping than its federal counterpart, the Peach State’s RICO law, under which Trump and 18 associates are now charged, makes it a crime to participate in, acquire or maintain control of an “enterprise” through a “pattern of racketeering activity” or to conspire to do so. Typical Misuses of RICO. Some of the cases where RICO has been misapplied border on the ludicrous, and include the following;
• The National Organization for Women (NOW) and other pro-abortion groups claimed that Illinois pro-life activist Conrad Wojnar and Des Plaines Pro-Life, a group of crisis pregnancy centers, engaged in “racketeering” by burying 5,000 aborted babies!
• The wife of comedian Pat Paulsen sued him for divorce under RICO.
• When rescuers blocked doors at a West Hartford, Connecticut abortuary in 1989, police savagely beat and molested them, causing scores of injuries. The town subsequently filed a racketeering suit against the publisher of the Orange County Post for the heinous offense of publishing an opinion column entitled “Redneck Justice,” which highlighted this police brutality.
An angry judge threw the suit out.

Certainly the most common intentional misuse of RICO has been against pro-life groups. Since 1986, more than 50 RICO suits have been filed against pro-life individuals and groups. Under the definition of ‘extortion,’ pro-abortion groups may allege that pro-lifers have engaged in a pattern or “campaign of fear, harassment, and intimidation.” “Extortion” has even been defined by some plaintiffs as “gaining satisfaction from “saving alleged fetal lives!””
The law is intended for groups like antifa as well. Organized domestic terrorists.
Eons ago, toward the end of my college career, I had time for an elective course so I signed up for something out of the Criminal Justice department called "Organized Crime".
Subject matter was more or less what you'd expect; instructor was a local assistant district attorney.

I came to the conclusion that RICO was intended for prosecuting anybody who annoyed the Powers that Be, or who owned property that the Powers that Be wanted to take.

For RICO to stick, it does not have to be shown that predicate acts enriched an individual, it only has to be shown that the “enterprise” got the illegal financial benefit. Where are the allegations of a “enterprise”? Where are the allegations of illicit financial benefit to the “enterprise” or to Trump?? This RICO count is super weak and should be first thing dismissed. Trump’s case is totally different and innocuous when compared to FJB. The FJB family and Hunter & the big guys web of LLC’s and other shell companies comprise the Enterprise in that case. Predicate acts are the extortionate demands of “pay to play” made to foreign businesses and officials. They are projecting onto Trump what they themselves have done/are doing.
This law is a for John Gotti and Victor Amuso. Not Trump.

We must remember that the purpose of all these indictments is not to gain a conviction necessarily (although it would enhance the argument that the charges are legitimate) but rather to tie up Trump’s ability to successfully run for President in 2024, drain his finances with legal costs and deny him top quality aides who would fear getting ensnared in the Lawfare. Most legal observers agree that Trump will ultimately prevail on appeal but this strategy being deployed against him will complicate his candidacy short term.

What Is Needed to Prove a RICO Claim?
Anyone can bring a civil suit if they have been injured by a RICO violation, and if they win, they will receive treble damages. To succeed in a RICO claim, a plaintiff must prove the following:
Criminal Activity: You must demonstrate that the individual or organization committed one of the RICO crimes, which include a broad range of crimes, such as blackmail and wire fraud. If you bring a claim on a fraud basis, the court will apply strict scrutiny.
Pattern of Criminal Activity: To have a successful RICO claim you must prove that there is a pattern of criminal activity – of at least two or more crimes. A pattern requires the crimes to be related in some way (or continuous), meaning it was conducted over at least a year.
Within the Statute of Limitations: The Supreme Court held that RICO has a five-year statute of limitations. Therefore, you must file a claim at least five years before discovering the criminal activity.

Thanks. I've just started watching it, but wanted to respond to you. When I saw Clint Eastwood's movie (Richard Jewell - 2019), I learned everything I needed to know about the FBI and DOJ, and the lengths they will go, to get someone. It was also apparent when Hillary Clinton sicced the FBI on Billy Dale, White House Travel Office Director...then Scooter Libby, who Bush never even stood up for, and Trump finally pardoned. There have been so many examples of the abuse of power conducted by these two agencies, and their politically-motivated aggressiveness, and yet not one person has been held accountable for any of it. Makes me feel at time that I'm living in Nazi Germany.
