Jack Smith Forced to Inform Court He Failed to Turn Over All Evidence to Trump Legal Team – Made 'Incorrect Representation'

Special counsel Jack Smith’s team admitted in a Monday court filing that his staff did not turn over all evidence to former President Donald Trump’s legal team, despite previously claiming that they had.

Smith has brought a total of 40 counts against Trump, accusing him of unlawfully retaining classified documents after leaving office and lying to the government about handing over all documents.

On July 27, Smith’s team filed a “superseding indictment” which further accused Trump of instructing his security staff to delete security tapes from his Mar-a-Lago resort only a couple of months before the FBI raided the Florida residence, Newsweek reported.

Others named in the indictment include Mar-a-Lago property manager Carlos De Oliveira and Trump aide Waltine “Walt” Nauta.

According to prosecutors, it was De Oliveira who told a Mar-a-Lago employee that “the boss” wanted a security server erased.

Now, it appears that Smith is the one withholding security footage.

In a July 31 court filing, Smith’s team admitted that they failed to upload video footage taken from Mar-a-Lago to an online platform where Trump’s defense team could review it, as required by law, according to Newsweek.

“On July 27, as part of the preparation for the superseding indictment coming later that day and the discovery production for Defendant De Oliveira, the Government learned that this footage had not been processed and uploaded to the platform established for the defense to view the subpoenaed footage,” read the filing.

The Government’s representation at the July 18 hearing that all surveillance footage the Government had obtained pre-indictment had been produced was therefore incorrect.”

The Brady rule is a legal standard that requires the prosecution to provide the defense with any exculpatory information that will be brought against them in court.

He should be preparing for Disbarment Proceedings while sitting in the county jail for 30 days for perpetrating Fraud upon the Court, as well as other deliberate acts of misconduct.

It's good to remember that this lawless persecution of Donald Trump isn't all about him. Anyone outside the Washington bubble who stands a chance at the Presidency would get the same kind of treatment. Washington's denizens know their antiquated, centralized "government" is hopelessly outmoded, and hopelessly corrupt. Trump, or anyone who wants to turn over a rock or two and peer beneath is an existential threat to them. "Official Washington" is a pure monopoly, and if it were a company it would have been broken up long ago, with its various agencies scattered to places where they could do the most good (Interior to Denver, for example, Commerce to New York, Agriculture to Omaha). It's come to the point where one antiquated, doddering crooked old dot on the map is willing to do anything to prolong its existence, even destroy the country it's supposed to be serving.

These trials are microcosms of what goes on every day. People really need to put themselves in Trump’s shoes and ask if it is fair.

I’ve put myself in Trump’s shoes and came to the conclusion that we have a corrupt law system in the USA.
This corrupt system is enabled by tax money, politicians, prosecutors, lawyers, judges, policing agents, media, juries, etc.

“It’s time to gut it financially” because it can’t be reformed.

If it proves nothing, it becomes part of the defense. All those attorneys and it got overlooked. It must be listed as an exhibit...and Trump's lawyers caught it.

I'd saay that the prosecution forgot to take it out of the suit.

Did the Grand Jury see what was missing?

I think the current policy of the DOJ is to withhold exculpatory evidence, lie when asked or otherwise compelled to make a representation to the court, and suppress testimony and evidence that may be detrimental to the prosecution. It’s the new Crossfire Hurricane ethical standards of the DOJ that apply when prosecuting Trump, his associates, supporters or anyone who has been seen wearing a MAGA hat, t-shirt or holding any sign or banner declaring a similar sentiment.
