'Tactical retreat': Democrats postpone blue state gun reform bill after chambers clash

The sweeping gun control bill introduced in the Massachusetts legislature will be postponed for debate until the fall amid disagreements between the two Democrat-led chambers.

"We remain disappointed that the Senate delayed our intended review of this gun violence legislation by insisting on its referral to the Public Safety Committee," House Speaker Ronald J. Mariano said in a statement to lawmakers Monday night.

The disagreement stems over which committee should hold a public hearing on the 140-page bill introduced last month. The House prefers the Judiciary Committee, which oversaw Beacon Hill’s response to the Supreme Court’s New York State Rifle & Pistol Association, Inc. v. Bruen ruling, while the Senate is pushing for it to go to the Public Safety Committee.

The bill proposes many changes to Massachusetts' current gun laws, including mandatory registration of firearms and magazines, a ban on carrying on private property unless expressly permitted, a ban on human silhouette targets in ranges, a prohibition on people under 21 from purchasing or carrying semi-automatic shotguns and rifles and many more.

"The House believes that the Joint Committee on the Judiciary is uniquely equipped to navigate the legal challenges brought on by SCOTUS decisions, just as it did during our initial response to Bruen and the overturning of Roe," Mariano wrote.

The Democrats in Massachusetts are fighting over which committee will have the pleasure of stomping on the citizen's rights. The in-fighting resulted in the legislation being put off until fall. Excellent!

Hard to believe that is the state where the US Revolution started back in 1775. And it was over gun control by the British.

The proposed Massachusetts legislation proposes revoking non-resident CCW and joining NY as the only other state which does not issue non-resident CCW.

This was always a problem for me visiting my elderly parents in NY. It will be a much bigger problem since MA is next door.

Has any court ever ruled that forbidding non-resident CCW while also not offering reciprocity is Constitutional?

7/05/2023 – Massachusetts: Commonwealth Proposes Unprecedented Sweeping Gun Control>/a>

1 Institutes a new, broad “Assault Weapons Ban,” including firearms already owned by law-abiding citizens.
Relying upon the GCA 1968 “sporting purposes” clause (actually dates back to NFA 1934). Reviving 1989 BATF import ban (with help from AG Bob Barr) and 1994 AWB. What about banning larger pistol calibers???
2 Bans all federally legally tax-stamped automatic firearms.
Scraps the NFA 1934 and NFPA 1986
3 Gun bans on possessing any gun, loaded, or unloaded at:
What about firearms left in vehicle in parking lot?
All state, county, and municipal buildings.
All polling places.
Any private property unless the owner has provided express consent or has posted signage allowing firearms on their property.

4 Mandates Safe Storage laws.
Expensive lockers/ safes. Annual inspections? $$$ What about ready availability for self-defense inside home? Trigger locks/ lock boxes??? What about mandatory personal codes for firearms to be functional, i.e., “smart guns”? $$$ Mandatory liability insurance coverage, e.g., in case of home fires that detonate ammunition in the presence of firefighters or stolen firearms that are used in crimes??? $$$
5 Mandates new training requirements including costly written exams and live fire training.
$$$ How frequent?
6 Mandates registration of all guns and feeding devices.
Universal firearm registration – what about a state firearm registry? Restrictions on magazine capacity???
7 Mandates reporting of any modifications or new parts to a gun.
8 Mandates serializing all firearm parts.
“Ghost Guns”/ 80% finished receivers – requires drilling holes, since not a firearm no S#
9 Bans anyone under 21 from acquiring or carrying any semi-automatic rifle or shotgun.
Hunting???
10 Bans anyone under 15 taking part in shooting sports and training.
Many kids start target shooting/ hunting at 12 yoa with single shot shotguns/ rifles.
11 Places new mandates, protocols, and training requirements on retailers.
Increased liability insurance coverage?

I know members of several local and state police departments. They all think this is stupid. The DAs don’t prosecute many of the existing laws.

MOST of these new laws would be used as “add ons” as the police would almost never come across them in a normal situation. I mean, how would the police know that I keep a firearm in my nightstand—unless they are searching my home?

I think this is going to die in the conference.

The ONLY things that are likely are the extra live fire training. Registration is pretty much a duplication of efforts—the state can find out what firearms I’ve bought in the state through their own records. They don’t need more bookkeeping at the Police Department.

Most guns used in crimes are brought in from out of state. Ghost guns are used—but they already carry a higher punishment when used in a crime.

Finally...I am not sure if I would need to notify the state when I put a new charging handle in my AR-15. That seems a bit silly.

Heller already ruled this UNCONSTITUTIONAL. It said, in short, one of the common uses of firearms is for home and self defense. To that end, the gummint MAY NOT mandate any storage/safety provision that delays the availability of the firearm for that purpose for even a nanosecond.

By the same token, you can't hold the owner criminally liable for whatever the criminal does with the firearm he has stolen.

It's not gun violence legistlation.

It's 2nd Amendment violating gun control legislation.

But leave it to democrats to deceitfully frame it to deceive the masses.
