Judge dismisses historic 1921 Tulsa Race Massacre reparations lawsuit

Tulsa, Oklahoma - A historic lawsuit seeking reparations for the last three living survivors of the 1921 Tulsa Race Massacre has been dismissed with no chance of refiling the case.

"Upon hearing the arguments of counsel and considering the briefs filed by counsel for plaintiffs and counsel for defendants the court respectfully finds and order the plaintiffs' second amended petition should and shall be dismissed with prejudice," Judge Caroline Wall wrote in court records posted Friday evening.

he public nuisance lawsuit – filed on behalf of survivors Viola Ford Fletcher (109), Lessie Benningfield Randle (108), and Hughes Van Ellis (102) – sought accountability and damages from the City of Tulsa, Tulsa County, the Tulsa Regional Chamber, and other defendants for harms inflicted during the infamous 1921 Tulsa Race Massacre.

This is where Juneteenth started, which the Federal government glomped onto. It’s awful what happened to the black people in North Tulsa, but a precedent for reparations should not be started. There is no one living who caused the riot, and just as the descendants of the blacks involved are not responsible, neither are the descendants of any whites involved in the riots responsible. No one is responsible for their ancestor’s actions.

However, the City of Tulsa requested the lawsuit be dismissed with prejudice against refiling, arguing in part that “simply being connected to a historical event does not provide a person with unlimited rights to seek compensation from any project in any way related to that historical event.”

“If that were the case, every person connected to any historical event could make similar unjust enrichment claims against every museum or point of remembrance,” the city claimed.


Makes sense to me.

First, I’m bleached white. As right wing conservative as they come. But if there was ever a case where reparations are in order...it’s Tulsa. This was flat out murder and destruction of U.S. citizens by citizens, local government, and maybe federal as well....I know they used WW1 planes to drop fire bombs at a minimum. Then tried to lie and cover it up. We’re talking 1920s or 30s. No civilized society does this. It’s a horrible sin and injustice, and it needs rectified. I’m dead set against the other reparations, but this one needs to be made right with those still living and possible very next of kin. God forgive us as a people for this.
