This issue of natural born citizenship comes up a lot on Free Republic.

Some Freepers say that both of your parents must have been citizens, at the time of your birth, for you to be a natural born citizen.

Other Freepers say, as long as you were born in America, a citizen by birth, the citizenship status of your parents don’t matter. Those Freepers say any citizen is natural born, if they didn’t attain citizenship through the naturalization process.

So which Freepers do we believe?

Consider that constitutional scholar, no less than Ted Cruz promoted the point that you had to have two citizen, parents to be a natural born citizen. Until he decide to run for president, and had to admit that his dad was a Cuban and that he was born in Calgary, Canada, where his parents were then living as residents. The issue has come up previously. When McCain ran for president., Congress actually passed a resolution to recognize that since he was born in Panama, while his parents were stationed there in the military, Congress was extending natural born citizen status to military dependents. Imagine otherwise that families would have to rush home to pop out their kids. The constitution is fairly clear about this, there are court rulings on this in the past, our current problem is the Supreme Court does not want to touch the topic, so they keep turning back challenges, saying that the challenger has no standing. Apparently no one has standing to address this issue. So it festers.

traditionally, citizenship, follow the father, then in the 60s I believe the law changed to follow either parent. Therefore, it seems as a practical matter that, if at least one parent is a US citizen, and the child is born in the US, there seems to be support that that kid is a citizen. But is there a clarity about whether the child is a natural born citizen since the second parent is not a citizen. if the child does not have dual citizenship, then it makes a clearer argument.

I and a few others are of the firm opinion, that if the child does not have two citizen parents, they are not a natural born citizen. They are just a citizen. Therefore, they are not eligible for president or vice president.

Personally, I will not vote for a ticket that includes someone not eligible to be president.

If Obama can be President, so can Vivek. Every time I hear him speak, yep is the first thing that crosses my mind. He is aggressive, confrontational and not afraid to win with the conservative view.......without being a jackass.

Seems like an All-American success story.

Obviously we need a clarifying amendment or a U.S. Supreme Court interpretation of the existing language, which has been bastardized six ways from Sunday to where no one is sure anymore. The problem is the courts refuse to give an ordinary citizen ‘standing’ so Vivek, who would have standing, would likely sue, which is a good thing because he would be the guy to bring it on.
