That’s exactly correct. By the time January 6th rolled around it was far too late to do anything to correct the 2020 election fiasco.

Yawn. The VP did not have the ability to refuse to certify. That was a tortured interpretation of the law.

I agree that the J6 prisoners are being over-prosecuted and am exactly with Trump on that one, but the Portland situation would not fall under federal jurisdiction, would it?

President Trump did not ask, tell or instruct Mike Pence to violate the constitution, he simply wanted Pence to send a request for election review *back to the state* legislative bodies, where a determination of election accuracy could take place, before federal certification. THAT state legislative process is exactly what the constitution outlines.

This approach might have been a sound one, but not on January 6th. Once the 51 slates of electors were certified in December 2020 there was no legal/constitutional mechanism to go back to the state legislatures for a “determination of election accuracy.” The election was deemed accurate as soon as the Electoral College vote was done and no disputed slates of competing electors were certified by any states.

Sending certified electoral votes back to states to “determine election accuracy” is like telling the President to re-do his state of the union address just to make sure he meant what he said the first time.

The President and VP are actually chosen separately. The presidential candidate doesn’t select his running mate. The party leadership does.

If he really wanted party unity he would have chosen Jeb Bush — or Mitt Romney.

Go back through recent history and see how many cases there were of President and VP candidates who couldn’t stand each other. I’ll give one notable example: Bill Clinton and Al Gore.

The Vice President of the United States has zero power, role, or authority to do the things claimed Pence could have done. The Constitution and the laws and Congressional rules governing the process make that abundantly clear without any ambiguity. There is no excuse for this level of willful and determined ignorance to keep going forward with this dishonest and false narrative. Not liking Pence doesn’t make it justifiable to lie about this process and the powers of the Vice President.

This “case” (which is actually not one) is Constitutional science fiction.

The “election” alleged to be fraudulent has no Constitutional existence. The 50 State Legislatures which appoint 535 Electors (and Congress, which appoints 3) have all adopted the custom of having people voting as the means by which the appointments are normally made, but this creates 51 elections, not one.

Those 51 elections occur at the direction of, and are subservient to, 50 legislatures and Congress. The States unwisely granted Congress 3 Electors by ratifying the XXIII Amendment in 1960, so Congress does have supervisory power OVER THOSE THREE, but not otherwise.

There is only one Presidential election in the Constitution, it takes place in December, there are 538 voters, and in December 2020 Biden got 306 of them and was elected President.

No State Legislature objected that its Electors were not the ones they had appointed. No State Legislature even convened to consider the matter. In the case of Pennsylvania, the Legislature fled to avoid considering the matter.

It has never been alleged that a single one of the 306 votes for Biden/Harris was a forgery, that the Electors who casted them were impersonating someone else, or that the Legislatures had secretly appointed other Electors.

There is zero space for an allegation of fraud in the Constitutional Presidential election of December 14, 2020.

As far as the 51 elections which occurred on November 3, 2020, they may very well have been rife with fraud, but since the appointment power of the 50 State Legislatures (535) and Congress (3) is plenary, that’s a problem for those legislatures to deal with should they choose to do so.

He seems to be inviting the criticism he gets and only muddying the waters on Constitutional ignorance with some of his rhetoric. Perhaps he thinks it can be a wedge issue to give him an opening or something. He deserves zero respect for that.

Pence is a modern-day Judas Iscariot. I have never heard anything more repulsive than when he pompously claims he was so upstanding on January 6 by choosing between supporting Trump or the Constitution and he chose the Constitution. Essentially, the coward claims he’s proud to have betrayed Trump. In fact he not only betrayed Trump, he betrayed his Constitution and his Country in what was one of the most pivotal moments in the Country’s history. It was a crisis moment for the Country and he failed like the traitor he is to perform his sworn duty to preserve and protect the Constitution from a Marxist coup taking place in his very presence - a coup that stole the 2018 election. He full well knew he was the last stop at the Electoral College to call into question the legitimacy of the Electoral vote count and he didn’t lift a finger to stop the Marxist coup. All he needed to do was to demand an Electoral recount by the states before proceeding. Now he shares a horrible historical legacy with Judas Iscariot.
