Pollak: Indicting a Former President over Nonsense Is Playing with Fire

Reports are circulating that federal prosecutors are about to ask a grand jury to indict former President Donald Trump over his handling of classified documents after leaving office. If those reports are true, and prosecutors do move against Trump, it would be the first time in American history that the government had prosecuted the leading opposition candidate. It would also destroy public faith in the rule of law and voters’ trust in democracy.

The documents charges are incredibly weak, from what has been reported publicly thus far. The president has full declassification authority, and there is no formal procedure for declassifying documents. Breathless claims of “national security” secrets, even nuclear codes, being brought to Trump’s estate at Mar-a-Lago turned out to be fantasies. Prosecutors may fall back on charges of obstruction of justice, which seem to be just as speculative.

The double standard is glaring. The Department of Justice let Hillary Clinton evade charges relating to her handling of classified materials. In that case, she kept an illicit private email server in her own home (possibly to hide corrupt fundraising efforts for the Clinton Foundation), erased it, and had her staff smash phones on which her emails were stored, rather than turning over the data and documents to the Department of State.

President Joe Biden himself, who called Trump’s handling of classified documents “irresponsible,” took files with him when he left the Obama administration.

fwiw The two impeachments were not mentioned one time during the 2020 campaign.

I don’t know why he would be the approved opposition candidate?

it took collusion of almost every industry and institution plus rampant cheating to beat him vs the GOP that won’t rally around him no matter the egregiousness.

Trump made the mistake of not ordering the Justice department to investigate/prosecute Hillary Clinton. Had he put that lying corrupt bitch in legal jeopardy, all the bullsh*t she pulled to promote that Russia conspiracy would not have happened.

Trump being kind is what got him in trouble.

Although nobody here likes him I think Christie would have gone after Cankles if he was AG.

Go back and watch his 2016 convention speech.

Jared wouldn't allow Christie to be AG because he locked up Jared's father when he was a prosecutor.

BTW Trump and Christie go way back.

Trump was impeached the first time because, we were told, he tried to have his leading opponent investigated. Now Biden and Garland are doing exactly that — and while Trump’s suspicions of Biden’s corruption were well-founded, and have serious national security implications, Trump is being accused of misplacing dinner napkins. Indicting him, for this, would open a Pandora’s Box and unleash passions that will not easily be controlled.

When the hell are patriotic Americans that actually have a working brain cell (not Democrats and RINOs, obviously) and know and see what the communists, our enemy within Democrats, are doing....

Obama’s ongoing fundamental transformation of America into AmeriKa needs to be brought to a rather screeching and abrupt END. By any means necessary.

Our founders, forefathers, parents and grandparents didn’t put their lives, their fortunes and that of their families on the line for this BS. Too much blood has been spilled ensuring our freedom in this nation for us to just roll over and play dead and dumb.

I agree, throughout the entire campaign Trump used the phrase “lock her up” and instead of getting that b*tch locked up, what did he do “Oh I just want to let it go, for the good of the country’ WTF ya think the Dems will be that nice to Trump LOL they want the man in a coffin and pronto..Trump was too nice and it cost him and he should have had Judge Jeanine as his AG, she would have prosecuted Clinton in the span of a week flat..yeah yeah I know, she is on Fox News, so what, she is a former judge and she would have nailed Hillary’s ass to the damn wall

I would add that Christie has been a Bush lackey for years, going back to when he was first appointed as the U.S. Attorney for the New Jersey District by George W. Bush in 2001. There's no way in hell he would have done a damn thing about Hillary Clinton's crimes.

This writer himself has just assisted in destroying the public faith in the rule of law because he doesn't know our form of government.
He even associates the rule of law with democracy when the rule of law is rightly associated with the Constitution which established our Constitutional Republic.

They won’t just indict. Given venues in DC and Miami they will convict. Not sure trumps worthless lawyers can do much against jury nullification.
