'Trump too small' -- US Supreme Court to decide

The case stems from an attempt by a California lawyer, Steve Elster, to trademark the sexually suggestive phrase and print it on T-shirts.

Elster's bid to register "Trump too small" was rejected by the US Patent and Trademark Office because he did not have Donald Trump's written consent to use his name.

A federal court of appeals disagreed, ruling that it was a violation of Elster's First Amendment free speech rights.

Somewhat ironically, it is the administration of Democratic President Joe Biden, on behalf of the US Patent and Trademark Office, that appealed to the Supreme Court.

Steve Elster spends years and years, dollar after dollar studying to pass the Bar and become a real Lawyer.
Now, what’s he doing? Suing over a three word T-Shirt slogan that sounds like a 12 year old wants to silk screen t-shirts for lunch money. I’m sure Steve’s family is very proud of him.

I’m surprised the Supreme Court is going to spend their valuable time considering it.

Those are 2 separate issues. Being rejected a trademark is not violation of free speech. He could still print that on shirts. It is just he can not claim exclusive rights to the use of that phrase

While I can see how being able to SAY or WRITE something is free speech....how does that extend to TRADE-MARKING it???

This is far too lame a statement to earn a trademark, no matter Trump’s permission or obscenity. It’s stupid and obvious and dull.

They article doesn't say they will take the case.

About a 1 in 5 chance they will take it.
