Just a few weeks after Special Counsel John Durham revealed significant failures to investigate allegations against Hillary Clinton’s family charity, a U.S. Tax Court judge has once again breathed new life into a years-long whistleblower case alleging IRS improprieties involving the controversial Clinton Foundation.
U.S. Tax Court Judge David Gustafson has already once before denied an IRS request to dismiss the whistleblower case, first brought in 2017. And three years ago, he ordered the tax agency to reveal whether it criminally investigated the foundation, citing a mysterious "gap" in its records.
The IRS filed a new motion to dismiss, and all parties filed arguments over the last year. But on Monday, Gustafson postponed ruling on those motions, instead asking for new arguments in light of three recent precedent-setting court rulings, once again frustrating IRS efforts to make the case go away.

Looks like a good judge, but I see his term is set to end in July. So they’ve just about run out the clock with him?

...But McCabe was infuriated, during the stretch run of the 2016 campaign, when the Wall Street Journal reported that he had tied the hands of investigators on the Clinton Foundation case.
Because McCabe’s wife, in her run for state office in Virginia, had received a hefty contribution from a fund tied to Clinton crony Terry McAuliffe, there was a strong suggestion of partisanship on McCabe’s part.
To push back against that, McCabe had his subordinates leak that the Obama Justice Department had pressured him to shutter the Clinton Foundation probe.
This was true. In fact, it is substantiated by Durham. He found that the bureau had meetings with top Obama DOJ officials who were hostile to the investigation.

Not sure, but he may be able to remain the judge for this case since he is most knowledgeable about it.
If I recall correctly, the two whistle blowers will be entitled to a massive award for litigating this case. Can’t remember if it 10% or 33%. That’s why they refused to give their documents and evidence to Congress when they testified at a couple of hearings.
Get back to us when someone but a low-level functionary goes to jail.
