I don’t understand. In your world the 14th Amendment is not part of the Constitution?

Fourteenth Amendment to the United States Constitution (adopted July 9, 1868), which states:

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Subject to the jurisdiction means, born of draftable parentage, for lack of a more concise and practical term, or a foundling, no parents appearing.

Not sure but I believe it is this clause that has been the subject of debate on the question of whether all those born in the U.S. being citizens.

unless they’re emigrating to the US, foreigners are not subject to US jurisdiction

“All persons LEGALLY born or naturalized...”

It does not read "All persons born or naturalized in the United States are citizens of the United States and of the State wherein they reside."

It is a basic tenet of statutory interpretation that no provision should be interpreted as being meaningless or superfluous, but that is exactly what people who claim that birthright citizenship is in the Constitution do.

“Under the jurisdiction thereof” is the key. Illegals don’t fit that.

People dropping out kids after crossing our border are NOT subject to the jurisdiction thereof - and neither are their children.

They never have been. The idea of birthright citizenship comes from a BOOK written by an ex SC judge who suggested the idea - but the idea of birthright citizenship has never been tested in our courts.
