Penny can’t claim self defense in this case just because Neely attacked someone else six months earlier.

Yes, this was an easy call for Captain Courageous.
Penny didn’t have to be aware of Neely’s prior arrest record, but he apparently had good reason to believe that Neely presented a threat to the passengers on the train. Many of the other passengers also considered him a threat. Neely’s criminal record makes it clear that he had a history of violent behavior, and makes the Marine’s actions that much more justifiable.
This is not the time to decide the case. I’m not saying Bragg will find the right outcome. It could very well be biased when all is said and done. But let’s wait and see until we have all the facts.
No harm in donating to his defense of course.

You said he had no weapon. He threatened to kill people. People are killed by “unarmed” criminals regularly. But you believe “he had no weapon” means he’s harmless, when just last year he had broken the eye socket of an 86-year old woman when “he had no weapon.”
I tend to agree with you, and surprisingly, it looks like we’re taking the most heat for saying this.
It sounds like Neely was making a lot of menacing threats, but he didn’t physically assault anyone.
I really fail to see, why the guy was held in a choke hold that long?
I don’t think the Marine intentionally tried to kill Neely.
What are the charges?
If the charges are murder in the first degree, then the guy will be acquitted.
If the charges are negligent homicide, I think he’ll be convicted.

What if it the Marine had a concealed license permit, and pulled out his gun, and shot Neely dead? Based on your and others here, the Marine was in his right.
We the People must protect each other on the street and in the courtroom.
I will not convict anyone of felony for taking out the trash.
