Texas Coordinates With ATF to Share Income of Residents for Warrantless Monitoring

Texas secretly gives its citizens’ incomes to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Documents show this has led to at least one person being monitored by the feds without a warrant through the federal gun background check system. The Texas Workforce Commission (TWC) told The Epoch Times that it has written contracts with ATF for “sharing income information” for criminal investigations. The revelation may lead to oversight by the legislature.

Texas state Rep. Briscoe Cain, a Republican, is “deeply troubled” about this coordination with the state’s unemployment agency and federal government.

“My office will be looking into whether the Texas Workforce Commission is assisting the ATF in the Biden Administration’s mission to violate the constitutional rights of law-abiding Texans,” Cain told The Epoch Times after reviewing the emails obtained by Gun Owners of America (GOA) as part of its ongoing FOIA lawsuit.

This is the third part in an exclusive Epoch Times series on the ATF giving information on innocent suspects to the Federal Bureau of Investigation (FBI) for daily monitoring through the National Instant Criminal Background Check System (NICS). The FBI uses NICS as a database of people who are prohibited from possessing or buying guns.

Texas is supporting ATF in providing income information to the feds to allow them to monitor citizens purchase of firearms without warrants. Their premise is the citizen doesn’t have the income to support the purchase of firearms. But why is Texas supporting the ATF if they are a Second Amendment sanctuary state?

My guess is, “Texas” in this case, is some woke leftard in Austin.

If a person gets a pink slip, the state unemployment entity is notified.

The state unemployment entity is then informing the ATF apparently.

While I can not support any infringement on Amendment II, I can support notifying the gun seller that the would-be purchaser has just quit, or been laid off or fired. Gun sellers should be able to make well-informed choices with regard to their sales prospects.

Now of course Jobless Jeb might need to buy a gun to keep his family fed and Jobless Jeb and his gun merchant should be able to arrange an appropriate purchase.

I would probably ask the question....if I’m only generating $1000 a month of income and buying a new weapon every three months, how is that possible?

There’s some parts of this story which don’t make sense. If a guy is retired and generating $1,700 a month...if he wants to buy a weapon every six months....more power to him.

Sounds like some kind of market where you report a break-in every six months, and your three pistols were stolen.

I don’t follow. What business is that of the seller? If the buyer passes the criminal background check and can afford the purchase, that should be the end of the story.

The biggest defects in the background check system involve schools.

Educators might inform the ATF in case of students getting booted or giving signs of malevolence.

I can support notifying the gun seller that the would-be purchaser has just kicked out of school.

I can also support supplying the gun seller with the full sworn statement(s) of educators regarding the mental suitability of a person to have a gun (along with the date the statement has been made [and the number of such statements the educator has supplied to the system]).

Gun sellers should be able to make well-informed choices with regard to their customer base.

Sounds really good on it’s face. It’s hard to disagree, and I was about to, then I thought about it a little. How is that conversation going to go? “Sorry, sir, you passed the background check but I cannot honor your second amendment rights and sell you this weapon because you lost your job recently”?

ATF already has income stats from the IRS so that’s irrelevant. What the income levels are being monitored for is.

Legitimate gun sellers do not wish to facilitate the murder of former employers.

And it should be, but unfortunately there have been deadly exceptions.

That’s a fair point. But it’s also a very slippery slope. Because any poor slob who gets on that unemployed list, for any reason, is now red-flagged. And any gun seller who sells to him anyway is open to a huge lawsuit should things go south.

And after that first huge lawsuit, gun sellers would simply stop selling to people on the list. It would be like having the right to vote, but having nowhere to vote.

I dunno. This is a tough, tough issue. We can’t have crazies shooting up places. And neither can we have 2A rights abridged. So I guess every possible solution should be discussed, but discussed very carefully.

Most vehicles are bought on credit.

When people get a mortgage their employer is often asked if continued employment is foreseen. I’m not sure how car finance works.

Most people get a new job fairly soon.

As soon as an unemployment tax payment comes in, the ATF could be notified and the pink slip notification expunged.

The gun buyer could also present their most recent pay stub to the gun merchant.
