WAUKESHA, Wis. -- Darrell Brooks is being ordered to pay more in restitution to the victims of the Waukesha Christmas parade tragedy, with an escrow account ensuring any money he earns -- including any money he might make in media rights deals -- goes to repaying what he owes.
Brooks had already been ordered to pay a total of $124,222.65 to Crime Victim Compensation and $47,193.29 to compensate the insurance company for the Waukesha School District, but a restitution hearing held Thursday added more money on top of those totals.
On Thursday, Brooks was ordered to pay an additional $10,246.20 to the Crime Victim Compensation Fund, increasing the total going to the fund to $134,466.85.
He was also ordered to pay hundreds of thousands more to reimburse insurance companies for a handful of victims, including $108,164.61 to Hartford Insurance for the person identified as Victim B, $118,805.62 to Optum Subrogation for the person identified as Victim OO, $10,000 to Progressive Insurance for the person identified as Victim GGG, and another $104,662.64 to Progressive Insurance for the person identified as Victim Q.
Between those payments and the money owed to the Crime Victim Compensation Fund, Brooks now owes a grand total of $523,293.01 in restitution. Both prosecutors and Judge Jennifer Dorow noted that total would be much higher if the community did not come together to collect donations for the Crime Victim fund.
A new defense attorney for Brooks argued against the added restitution payments, adding his inability to pay what he already owed based on the small amount he was earning while in prison. Prosecutors also recognized Brooks' inability to earn income right now, but wanted to ensure any future money he earns -- including through any book, movie or true crime series deals in which he would sell his perspective -- would go to the victims.
It was a point that resonated with Judge Dorow, who noted during her comments in ordering the additional restitution that while it is not likely Brooks could be paid to tell his story, it is possible, saying "you only have to look at Netflix" to see there is an interest in crime stories.
Brooks will also have a portion of his prison wages garnished to go toward his restitution repayment, although the amount is capped by state law. Still, Judge Dorow said, it would be a constant reminder of why he couldn't afford the buy extra items while serving his life sentences.
