A judge in Delaware has ordered a jury trial in Dominion Voting Systems’ blockbuster lawsuit against Fox News, setting the stage for one of the most consequential defamation decisions against an American media company in decades.
Lawyers for Fox and Dominion faced off in court during a two-day hearing for summary judgment last week, with each side unsuccessfully arguing the court should rule in their favor and forgo a jury trial that is expected to span weeks and could further bring to light internal discussions at the network following the 2020 election.
Dominion is suing Fox for $1.6 billion in connection with what it alleges was the network’s airing of false information about the company’s software, claims promoted by former President Trump’s associates and allies after the election.

But for the plaintiff. The judge has already determined that the Fox reports were false.
That said, I’ve been troubled all along by the plaintiff’s ability to show damages. Did they lose any contracts as a result of the reporting? Not that I’ve heard but then again, as with most legal issues, the media is too lazy and stupid to be aware of, let alone report on, what the actual claimed damages are. This is a “1.6B lawsuit” because that’s the arbitrary label plaintiff put on it. They could just as well have labeled it $500 million or $9 billion. That’s another thing that irks me about reporting on lawsuits… never once have I heard it reported that the amount of the lawsuit is plaintiff’s arbitrary number they slapped on it

An important piece of argumentative information which should come up is that the democrats, themselves, use to make all sorts of crazy claims about Dominion machines in previous election cycles and Dominion never pursued. A history of conscientiously not challenging a claim IS a weighted factor.
