So, I guess river navigators are the latest assault on property rights.
We own property on a federally protected river.
The state wants to further “protect” it by developing a state park so that
masses of people from all over can enjoy it and float its pristine waters.
They also want to stop the access of local cattle farms to the river for their cattle.
Personally, I prefer the cattle.

No. The fire resultd from packing being inadequate, not who knew what. Bearing packings are supposed to be checked every so often in accordance with a protocal. Who does the checking can be complicated. The car owner normally subs this to some transportation company. Tracking cars is complicated as is designating when and where the car will be checked. It will take a long time to figure it out. The process will begin with determining the travel and operational history of the car for the last several months. I suppose all railcars are now equipped with RFRID tags so the first step will be less time consuming than in the past. NS was just trying to knock out residuial law suits by sending checks that had have a tort action waiver signed to cash. Pretty common as the personal injury lawyers will try and make this a combination of the Abestos racket and the Horizon 6 event.

Norfolk Southern is liable as well. They are the company owner, any carrier is a contractor and hired/paid for NS, therfore, they have direct liability.
