New Biden gun grab based on just two shootings
Washington Examiner ^ | 20 jan 2023 | Paul Bedard

The Biden administration’s weak case for abruptly imposing new rules and taxes on firearms long free from them is giving hope to some Second Amendment advocates that decades of gun laws dating to Al Capone’s days will finally be killed by the U.S. Supreme Court.

The about-face on regulating millions of AR-15 style “pistols” and forcing owners to register them or face jail and fines is already being challenged as an overreach by fervently anti-gun President Joe Biden and his Bureau of Alcohol, Tobacco, Firearms, and Explosives.

“The part I’m actually excited about is that we have a Supreme Court that has smacked down the ATF repeatedly recently,” said gun expert Larry Correia, citing cases bolstering the Second Amendment.

—from the article—

“For example, deep in the new 293-page rule, the ATF gave its evidence the weapon is dangerous. It cited two recent mass shootings, one that killed nine in Dayton, Ohio, in 2019, and another that killed 10 in Boulder, Colorado. Both involved shooters with known mental problems who still apparently passed FBI background checks.

And it added that since 2015, it has worked on “approximately 105 firearms cases or investigations” involving the pistols equipped with stabilizing braces, out of 10 million-40 million estimated in use by the bipartisan Congressional Research Service.

Who will enforce these mandates? I am certain that many local law enforcement agencies will balk at kicking in doors of law abiding citizens. Doesn’t the Constitution also expressly prohibit ex post facto laws?

they didn’t “abruptly” impose new national security / border security measures in response to the diabolical crimes that are on the increase from the cartels and others freely crossing back and forth on the border, did they?

Who will enforce these mandates?

The local city police will enforce them. So will the State police. Those who won't enforce the orders will be quickly replaced by others that will.

County Sheriffs could go either way.

They will come down hard on a few conspicuous individuals and completely ruin their lives. What the courts might do will be too little, too late. The persecuted ones will run out of money, time, and even life during endless waits for the appellate courts.

The Constitution means nothing but a speed bump to the gun grabbers. Stopping them will involve actions outside of the realm of the courts.

What’s next;
All rifle buts must have pads removed and spikes installed.
You know, you shouldn’t be able to shoot a rifle without pain.

”... the ATF gave its evidence the weapon is dangerous...”

What a bunch of jerks. All weapons are “dangerous,” sorta like knives, hammers, chain saws, and automobiles.

It’s not hate America. It’s hate freedom for the peasants. It’s the attitude that the government is there to rule you not to protect your freedoms if everyone who worked in the ATF dropped dead tonight the country would be a better place.

It does. This isn't one.

"Owning this object is now illegal. You have 90 days to dispose of it in an approved manner." is not an ex post facto law.

"Owning this object is now illegal. If you currently own one, or ever owned one in the past, we will arrest and imprison you." is an ex post facto law.

The entire NFA/GCA structure is a Second Amendment violation and an enumerated powers violation.
