Community activists in Houston are calling for a restaurant patron who shot and killed a robbery suspect during a holdup to be arrested, saying he went beyond self-defense despite many calling him a hero.
Customers were eating inside a local taqueria when 30-year-old Eric Eugene Washington entered and pointed a pistol at them and demanded cash. As he gathered the cash, an armed patron can be seen on surveillance video getting up from the booth he was sitting in and shooting his pistol at Washington multiple times.
"He was within the law when he fired the first initial shots," said activist Quanell X in a news conference in front of the establishment. "But we believe he went from being a law-abiding citizen to a lawbreaker."
Washington ultimately fell to the ground and died. The unidentified shooter has not been charged and has cooperated with authorities.
The man's attorney released a statement saying: "In Texas, a shooting is justified in self-defense, defense of others, and defense of property."
The armed diner has been hailed a hero by many but local activists said he went beyond self-defense when he fired several more times than needed to neutralize the threat posed by Washington, who was holding a fake gun.
"You do not go and shoot someone over and over when they are no longer a threat," said Candace Matthews of the New Black Panther Nation. "He was actually in the clear for a justified kill by shooting him like he did the first time when he was no longer a threat."

Or, they knew from staring at the screen that the gun was fake, so someone could have just said no and punched him real hard to go away.

Had the defender emptied all his rounds immediately = self defense.

That’s an argument before a jury.
I personally would vote not guilty.
But the gap between shots and the head shot is a problem.

I’m not sure of the exact language involved, but if you
present a toy weapon at the counter, I believe you are
charged with armed robbery because the owner/employee
doesn’t know it’s just a toy. To them, they are under
threat of their life.
It’s stupid to pull a stunt like this. To the patrons
there was the threat the kid would turn around and fire
at will
Hate to see a kid die young, but you know, he got up
and decided to temp fate. Fate won.
I don’t care about the angle of the shooter. The kid
was a threat. Good on the shooter > IMO.
Honestly, until things cool down, I'm all for folks erring
on the said of shoot first and figuring it out later.

Those same people are probably just fine with cops who shoot people ten times, reload, and shoot them another ten times.
On a strictly legal analysis basis, and based only on the video evidence, this one appears to have gone from “lawful to awful”, probably with the final shot.
It’s not clear what the DA and grand jury are going to do, as the general tenor down here is that people are sick and tired of the general lawlessness, and in particular robberies in that part of town.
This is one to study for anyone who carries.

No one can determine what the shooter’s thought process was. It has to determined that his actions were reasonable.

The first shot killed him. The rest were just shooting a corpse.

I've thought since I read about it that the only thing they can convict him on is abuse of a corpse.
