Due process says "Are you nuts?". Civil suit yes, criminal endangerment (Usually a misdemeanor offense at "best") yes. Gun laws concerning concealment/securing firearms, a felony, yes (No hard jail time at the moment though). Prosecuting for the actual wet work, no, opens too many cans of worms for the State/Feds to run wild with for persons isolated from intent. That is if the child took the firearm from home/parents btw.
What would your punishment for the parents be if the child got the gun from a third party? Just throwing that out there. Difficult case indeed.

I agree 100%. The child had a firearm because of parental failure. If the biological father was not involved in raising his child, charge him with neglect and abandonment too.
