Can anyone elaborate on the legal/constitutional basis that Stevens was able to do this? It’s not that I disagree with Title 42, but what is the current health emergency? It was a weak method to implement immigration policy. I get the fact that Congress wouldn’t do anything and the Executive branch doesn’t enforce existing immigration laws.

The real policy we should be looking at is the "remain in Mexico" policy.
As to 42...I'd say as long as they're recommending vaccinations, the policy should stay in place.

One that I would call the “Blind hog finding an acorn every once in a while” is one she made about “seeing” Lady Liberty on a throne, throwing goodies to the poor. As her throws got wilder, more and more came to get the “free stuff” that they overwhelmed her.

The logical basis is that non-US citizens must be vaccinated in order to enter the country. Therefore, if a non-US citizen crosses the border illegally, they can be rapidly deported unless/until they prove vaccination status.
It’s one more arrow in the quiver fighting illegal immigration.
