And the problem remains that Congress cannot appropriate funds for anything that it cannot reasonably justify under its constitutional Article I, Section 8-limited powers, no mention of union pensions in Section 8.

Right.

The problem is that they will pass anything they feel like passing, knowing full well that it will take years of court battles (both sides paid by the taxpayers) to undo it.

And no one will be punished.
