Elon Musk responds to Donald Trump's calls to 'TERMINATE' the Constitution
UK Daily Mail ^ | 12/5/2022 | Stephen M Lepore

Posted on 12/05/2022 2:47:47 AM PST by fruser1

Twitter CEO Musk responded in a tweet: 'The Constitution is greater than any President. End of story'.

Just before 8am on Saturday morning, Trump took to Truth Social to assert that Musk's exposé, published by journalist Matt Taibbi, proved 2020 was 'fraudulent' and called to strip current election laws from the US Constitution.

Not according to the Constitution.

The States certify the Electors ballots and send them to the President of the Senate. The President of the Senate opens and counts the ballots.

Headline doesn’t match what Trump said.
Trump said the election was fraudulent. The twitter information says the same.
Biden hold the office unconstitutionally, because it was obtained by fraud.

Trump wants to restore the Constitution, by denying victory to those fascists who took over.

Anybody notice that the groups, FBI and Homeland, who are supposed to guard against election fraud, committed election fraud and investigated themselves and said it was “free and fair”?

Bill Barr, you are a fascist and a liar. You would have done well working with Hitler. Don’t be appalled, you chose to destroy the thing you were employed and sworn to protect.

It’ better than what any other country has.

It does not have any specific text as to what to do in the event of fraud.

Going back to the point of the article and post - the claim is that Trump wants to “terminate the constitution” based on his tweet.

I’m offering my interpretation - what he actually does is ask if in the light of rampant fraud, should there be a declaration of the “true” winner or have a new election.

The immediate response to such a question might be that we can’t do that because it’s not constitutional.

As such, my opinion is that the tweet is just a form of rhetoric where, after the question, he proffers the counter argurment to the expected response, which is basically “fraud voids all contracts”.

And if it’s found that the electors were duped by fraud, then what?

Declare the rightful winner? Call for a new election?

This is what Trump is asking.

The next sentence he tweets is just another way of saying fraud voids all contracts. Since there is nothing in the constitution addressess this specific thing you can go back to the english common law precept of fraud voids all contracts and congress can act how it chooses - like declare the rightfull winner or call for a new election.

I admit that I don’t think I quite understood what Trump meant by those remarks. I do know that it sounded somewhat over the top and like a potentially dangerous proposal if taken verbatim. I was rather glad there hasn’t been much media reaction thus far.

3 USC 15, permits congress to make objections to the state certification.

The Constitution is magnificent. It created the first national government that wasn’t controlled by some absolute sovereign. It was created to temper the power of government. Read my tagline.

The left hand crooked election stealing helper so called media is predictably trying to make President Trump look bad again.
All he said is that when we are off road from the constitution then some off roading may be required to get back to the constitution where we belong.
Chuck Retodd and cronies need a good trashing.

Trump is saying that if you violate the Constitution to steal the WH, you can’t run and hide behind the Constitution to then defend what you have stolen.

Sure wish Trump would have said it this way.

I can’t imagine a fraud that would occur in this context.

Please be more specific.

Or are you saying that the vote to approve the constitution in 1789 was fraudulent?

Imagine a football game when one team must play by the rules while the other team do whatever they want.
The refs won't say anything and anyone in the audience who points it out gets evicted from the stadium.

Do we have to break the rules in order to fix the situation or can this be resolved legally?
That's the question.

I don’t think that’s what Trump was saying. I believe that he was implying that if the Dems get away with cheating and stealing the election, we might as well trash the constitution.

That being said, it was not a clear statement. Trump needs an editor !
