For millions of student loan borrowers, the lucky break that might evaporate

Tens of millions of Americans who thought they’d gotten a huge and unexpected break suddenly can’t be sure.

In August, President Biden told those laboring under obscene amounts of student loan debt that if they earn less than $125,000 per year, they would be eligible to have at least $10,000, and possibly up to $20,000, of that debt forgiven. Since then, 26 million people have applied for that relief, and 16 million have been approved so far.

But now they’re in limbo, as a slew of Republican-led legal challenges claiming that Biden’s order exceeds his powers have frozen the loan forgiveness program, and threaten to scuttle it altogether.

If that happens, most of those millions of people will be right back where they were before, facing the same financial burdens.

However there is one group of borrowers who would be not just back where they started, but actually worse off than if the president had never attempted loan forgiveness in the first place. And the only thing they did to deserve it was to be born too early.

Some say lucky break. Others say scamming tax payers for something most didn’t receive and are not in debt for.

Biden knew he didn’t have the authority to ‘give’ a $20,000 perk to a group that overwhelmingly votes democrat.

It was a scam to turn out the vote for his party.

Awwwwww. The poor darlings. Getting a college education and having to actually “labor” to pay it off. Fetch me my clutching pearls and sobbing cloth. I just can’t get through this pathetic story without uncontrollable crying.

Oh well, the disingenuous gesture served its purpose….got a few more real votes…it is unconstitutional and grotesquely unfair…but that doesn’t bother this ‘administration’…

Imagine how inexpensive college would be if the government wasn’t artificially inflating costs to begin with with their pell grants, government backed student loans, and now government lending student loans. All of that meant big money going to colleges so that colleges raised tuition rates and other fees.

Railroad union workers thought Brandon would stand strong with them in their fight against management until he turned the matter over to Congress.

Student Loan borrowers are getting an even larger break which has gone unnoticed. The DOJ announced a policy revision which would allow those owing student loans to discharge them in a simple bankruptcy. The Bankruptcy Code requires a showing of "Undue Hardship" before the debtor can discharge a student loan, but that term was never defined by congress. In the years since the Code was adopted in 1978, courts have interpreted "Undue hardship" in a very restrictive manner, requiring an almost Social Security Disability level of hardship before allowing the loans to be discharged.

The procedure in bankruptcy requires a debtor to file a lawsuit (and adversary action) against the DOE if they want the court to consider releasing them from their student loans. Under the new guidelines, the DOJ, the government agency representing the DOE in Bankruptcy Court, will roll over in these lawsuits upon a much lower threshold of hardship amounting to a mere imbalance in present income and the debtor's reasonable expenses apart from the student loan payments. There is even some suggestion that the DOJ will allow debtors to open bankruptcy cases filed in the past to discharge student loans if they show a present hardship.

Joe Biden made the promise before the election. He doesn’t seem to be doing anything to overcome the court ruling. I suspect that it will quietly die since the goal of getting votes was fulfilled. There is no way in hell that the financial status of the student borrowers was in any way a concern for the White House staff.

I’m not on their side, (I repaid my school debt) but the debts you list can be discharged in Chapter 7 bankruptcy.
Student debt cannot.
