Federal judge blocks Florida law against 'woke' teachings in colleges, calls it 'positively dystopian'

A federal judge temporarily blocked a Florida law aimed at restricting state colleges and universities from teaching students certain ideologies related to race or sex.

Chief U.S. District Judge Mark Walker of the Northern District of Florida blasted the "Individual Freedom Act," originally pitched as the "Stop WOKE" Act, for censoring what professors are allowed to teach, granting a preliminary injunction against its enforcement while litigation continues.

"The law officially bans professors from expressing disfavored viewpoints in university classrooms while permitting unfettered expression of the opposite viewpoints," Walker wrote in a Thursday order. "Defendants argue that, under this Act, professors enjoy "academic freedom" so long as they express only those viewpoints of which the State approves. This is positively dystopian."...

Judge Walker said that "both sides go too far in conflating legal concepts," but ultimately sided with the plaintiffs, stating that Florida's logic would give the state unlimited "power to expand its limitation on viewpoints to any idea it chooses."

The way to stop this is by stopping all funding by the state of state colleges that teach this crap. As it is 98% of the time, the money is the answer.

On March 30, 2022, Walker ruled that Florida Senate Bill 90 violated the Voting Rights Act, issued a permanent injunction against the law’s restrictions on absentee ballot drop boxes, and required Florida to obtain preclearance from federal courts before enacting election laws.[15][16][17]

In an outline of the legislative history of the bill, Walker wrote, “And the exact justification for SB 90 as a whole, and for its constituent parts, is difficult to pin down, with sponsors and supporters offering conflicting or nonsensical rationales.”[18]

On May 5, 2022, the 11th Circuit Court of Appeals lifted Walker’s order, pending appeal: “The lower court’s ruling relying on an analysis of racism in Florida’s history is “problematic,” and “failed to properly account for what might be called the presumption of legislative good faith,” according to the order issued Friday by the U.S. Court of Appeals for the Eleventh Circuit. Additionally, the state has “a substantial argument” that another provision in the law governing “line warming” activities outside polling places “passes constitutional muster,” though the lower court found it to be “unconstitutionally vague and overbroad,” according to the order. The court also noted the next statewide election is in August, while local elections are ongoing—too close for interfering with state laws administering elections, the judges wrote.” The appeals court did not reach the merits, which will be decided in the main appeal.[19]

It is a STATE LAW, Tenth Amendment.

All powers not exclusively stated as for the feral gooberment are for the STATES.

So PO. Ignore him and tell him to bring his army.

Governor Faubus was right and Eisenhower was out of line.

Academics are free to agree with all the other academics, and if they don’t, they lose their tenure, have students howling in rage at them everywhere they go, and the other professors egging them on on the QT. They also have the freedom to STFU if they know what’s good for them.

I didn’t know a judges view of dystopian qualified for a legal ruling. Where in Florida constitution does it say that?
