...Texas voting law previously banned wearing political shirts of any kind to the polls. But a group of firefighters in Houston took the clothing rule to court in 2018 after they were asked to leave a polling location for wearing T-shirts that supported a proposition that didn’t appear on the ballot that year.

After a lengthy legal battle, the federal judge ruled in favor of the firefighters. Now, voters are allowed to wear political shirts supporting a candidate or measure — so long as they do not appear on the ballot in the current election.

“For example, if somebody wants to wear a Reagan/Bush or Clinton/Gore shirt, those folks are not currently on the ballot, so they can wear political apparel from past elections or elections not currently on the ballot,” Taylor said.

However, wearing shirts that support O’Rourke, Abbott or other candidates running in this year’s midterms is still illegal. Wearing clothing related to something on the ballot is restricted not only at the polls, but also within 100 feet of the polling location and is considered a type of “electioneering.”...

Can I wear a MAGA hat?

Yes, you can, since former President Donald Trump is not running in the 2022 midterm elections and will not appear on the ballot....

What happens if I wear a campaign-related T-shirt?

It’s best not to wear a T-shirt related to one of the candidates on the ballot, unless you’re okay with being charged with a Class C misdemeanor, which can carry up to $500 in fines.

But in case you forget or don’t have another shirt, you will likely be asked by a poll worker to turn your shirt inside out or cover it up with a jacket.

My mom wore a REAGAN button when she went to vote in the 1976 Connecticut primary (she was a registered Dem in those days). The poll workers made her remove it even though there was no Republican primary.

I go as plain as plain can be to the precinct....why would I surrender my position and help them f with my vote?

I wish the Supreme Court had not scuttled the electioneering laws. It used to be much easier to when all clothing promoting issues or candidates was banned. A voting precinct is supposed to be a safe place for people to mark their choices on ballots and submit them anonymously. As an election judge or alternate judge, I have ordered people to turn their shirts inside out before entering the precinct.

Same here. Yes, I could wear my MAGA cap, but why give some poll worker the chance to deny my vote? Anyway, it’s not as though some other voter will see the cap and decide to switch from voting Democrat to voting Republican.
