Pennsylvania Democrat Gets to Keep Seat Despite Illegal Ballots Likely Handing Him Victory

Despite the Supreme Court ruling in favor of the Republican challenger in a local election in Pennsylvania, the Democratic winner will keep his seat, despite the fact that his victory may have come from hundreds of ballots the Supreme Court deemed illegal.

More than two hundred mail-in ballots cast in the race were challenged by David Ritter— who lost his election for the Lehigh County Court of Common Pleas to Democrat Zachary Cohen by a margin of only five votes—on the grounds that the voter signatures did not include dates. In accordance with state law, absentee ballots in Pennsylvania must be signed and dated.

But despite the hundreds of ballots being thrown out, Ritter’s election loss will stand, and Cohen will keep the seat. Whether or not those illegal ballots would have changed the outcome of the race isn’t clear, but according to an analysis by FiveThirtyEight, 76% of Pennsylvania absentee voters voted for Biden, while 65% of in-person voters supported Trump. So, it is highly likely that Democrat Zachary Cohen is not the legitimate victor of the election, but he gets to keep his seat nonetheless.

You can’t keep an elected seat if you you obtained it by fraud. If he keeps the seat, we don’t have democracy or justice.

This is poorly written and explained. It appears that SCOTUS did not invalidate the election. It simply ruled the unsigned mail in ballots unlawful. Presumably, the writ of quo warranto is still available to the aggrieved party, as well as disgruntled litigants in the illegitimate judge's court room, since it is codified in Pennsylvania statutory law.

What good is it deciding that he lost and then letting him keep his position? That is WRONG on so many levels.

So, what is the PA and national GOP doing about this?

The PA General Assembly (legislature) is controlled by republicans. The PA Supreme Court (PSC) and governor's office is controlled by partisan democrats. An ongoing problem in PA is that the PSC repeatedly strikes down laws passed by the PA legislature.

My understanding is the the PA Constitution gives the PA legislature sole power and authority over election/voter law. In 2020, PA Governor Wolf along with rulings from the PSC completely ignored PA voting/election rules. The PA legislature took the matter to the USSC who chose not to take the case.

The PSC is not the final authority! It does not have preeminence over the other branches but acts like it does. The time has come for the PA legislature to tell the PSC that it's rulings are unconstitutional and they will not be obeyed. Let a constitutional crisis ensue!

Do I think the PA GOP will take what I believe is this needed action/position? Sadly, NO!
