Layoffs at Twitter started on Thursday evening as part of a series of sweeping changes made during billionaire Elon Musk's first week at the helm of the social media platform.

A class-action lawsuit has been filed against Twitter on behalf of workers claiming the company’s layoffs violate a federal law requiring 60 days of advanced notice for employees.
One worker in the lawsuit was let go Tuesday and three others were locked out of their accounts Thursday "which they understood to signal that they were being laid off." The court document asserted Musk "recently engaged mass layoffs" at Tesla without notice and then attempted to obtain releases from laid off employees "without informing them of their rights under the federal or California WARN Acts."

WARN violation incurs $500 fine and there are are exceptions, which he will undoubtedly claim. He made the decision it would be cheaper to pay the fine than to let the Twits tear the company apart for 60 days. Plus he’s paying them so that mitigates penalties.

I don't think so only for the fact that so many companies have left, although I think that might be more due to overtime issues.

They are locked out and put on notice that they are being let go BUT are employees until Jan or Feb. The key part is that they are locked out and can’t sabotage anything. They are getting paid, etc. until Jan or Feb. Don’t see the case.
Most companies just give them 60 days pay, tell them to go.
Lawsuit says employees didn’t receive 60 days notice of layoffs. The letter sent to employees that someone posted in another thread says that layoffs were effective Feb 7, 2023 and they would receive full pay and benefits until then. That’s 3 months notice.
Employees who were scheduled for termination can’t go back to work and can’t be on Twitter property, pretty standard in the tech industry. Security usually escorts you off the property immediately when you’re notified that you’re terminated.
It is an At Will state. I know from first-hand experience.

Has this law ever been tried in an appellate court or USSC? It is blatantly unconstitutional since it violates the right of free association. Not only that, it injures business owners by forcing the to pay unwanted people or pay a fine.

If they do, thet are still employees. Damaging company property is a no no, even for leftis’s throwing temper tantrums.
Maybe they are not being laid off but FIRED for cause. Who says they should get 60 days for that?
