January 6 panel member Adam Kinzinger said that the select committee will likely need to 'negotiate' with former President Donald Trump to get him to comply with their subpoena.

Comes as fellow panel member Stephanie Murphy revealed that they will seek to call back U.S. Secret Service (USSS) officials to testify under oath after revelations from the public hearing last week shows that they knew about the threats facing the Capitol.

Kinzinger, one of the two GOP members of the panel, said that it might not be so straightforward to get Trump to testify or hand over documents after the nine members voted to subpoena him at their meeting on Thursday.

These fools have already lost.
If he ignores them, they are humiliated.
If Trump sets the terms (live TV) just ask Megan Kelly how that goes. LOL

No reason? Well, maybe. If the Trumpster shows up and they ask him a question they have to listen to his answer-—even if it takes two hours. What an opportunity for him to read into the record every bitcheroo he’s had for the past six years. I’d buy a ticket for that. Sounds a bit like Kinzie has figgered that out and maybe wants to “negotiate” a limited discussion. Trump could talk from now to the election.

Nah, I got that part. lol Here's the thing: "negotiate" means essentially cutting a deal with President Trump. Why would the dems do that, ceding power to Trump, when they could use the full weight of the contempt charge instead?

Why that particular play?

How can the Justice Department execute arrests for failure to respond to subpeonas...

Technically, there is no such thing as failing to respond to a subpoena. There is failure to appear, but there first has to be an established appearance date, time, and location, and then President Trump has to fail to appear before the DoJ can act.

Okay, I'm confused. If President Trump doesn't show up, that's contempt of Congress, right? Gets handed off to the AG and all that stuff for prosecution? So what's to negotiate? What am I missing?

I've argued that President Trump does not have to show up because he can claim separation of powers.

The Committee is demanding that he appear before them to explain his actions on or before January 6th, while he was still President. The President is a co-equal branch of government and does not answer to Congress outside of an impeachment trial. Lesser officers, like Cabinet members who are confirmed by Congress must appear when called, but not the President.

In fact, Article II Section 3 gives the President the power to "on extraordinary Occasions, convene both Houses, or either of them," and also "in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper..." This means that the President has the limited power to both convene and adjourn Congress, but Congress does not have the power to order the President to appear before them.

President Trump is no longer in office, but I believe he can argue that he's still protected for actions taken while he was President. He does not have to justify his presidential actions to Congress outside of an impeachment trial in the Senate.

How does it work when the DOJ is issued subpoenas for information, which they almost never answer until two or three (or more) years after Congress has issued them?

It devolves into a game of chicken, who has the will to act first?

In 2018, the House Intelligence Committee issued a subpoena to the DoJ to release documents related to their Russia investigation. Deputy Attorney General Rod Rosenstein ignored those subpoenas and said he will not be "extorted" by Congress.

What are the remedies? The President could fire the officer, Congress could start contempt of Congress proceedings, or Congress could start impeachment proceedings.

Of course, none of that happened because Rosenstein was unaccountable and untouchable at that time.
