Court declares DACA program illegal, but leaves policy intact for nearly 600,000 immigrant "Dreamers"

A federal appeals court on Wednesday said the Deferred Action for Childhood Arrivals (DACA) policy violates U.S. immigration law, dealing a blow to an Obama-era program that provides deportation protection and work permits to nearly 600,000 immigrant "Dreamers" who lack legal status.

A three-judge panel for the 5th Circuit Court of Appeals concluded the Obama administration did not have the legal authority to create DACA in 2012, affirming a July 2021 ruling from a federal judge in Texas who barred the Biden administration from enrolling new immigrants in the decade-old program.

Despite its conclusion, the appeals court did not order the Biden administration to shut down DACA completely or stop processing renewal applications, deciding instead to leave in place an order from U.S. Judge Andrew Hanen that left the policy intact for current beneficiaries. The government, however, will continue to be prohibited from approving first-time DACA applications.

We declare that bank robbery is illegal, but all pre-existing robbers can continue doing what they were doing. They can continue to profit from their illegal actions. How lawless the courts have become.

I hate the “Dreamer” moniker.

Real Americans have dreams too.

The policy was illegal but the moron “judges” want to let 600,000 illegal ‘RAT voters become citizens because the RATS need more voters? That’s booschitz. These damn judges are the morons who are illegal. Aiding and abetting.

"... 600,000 immigrant "Dreamers"..."

Yeah... Sure...
What about the 2,000,000 members of the dreamers' extended families that were allowed into the country?

If the court doesn't deport them, this is just a copout by the courts...

Freaking vermin need to be sent back to where they came from..

The U.S. Supreme Court could simply let the appeals court decision stand, which helps John Roberts avoid criticism.

Well said.

I was thinking of robbing all my neighbors, having the judge declare that illegal but I can keep the money as my policy of robbing them remains in place.

It’s really amazing. It’s been illegal since 2012. All along. Ten long years of lawlessness. Next up: student loan “mass forgiveness.” Illegal now and illegal 10 years from now but by then it another decade of lawlessness…

Do the hard work now or face a future where it will be impossible. It never said in the constitution that judges get to rule our lives.

So deport. We don’t get to squat in their countries either dammit.

Nobody is deporting them (even Trump admitted that); the fact is the elites need a servant class and Americans won’t breed them (too many of the few American children born today will provide 0 productivity for anyone).

In addition, these “dreamers”, their extended families, and illegals as well, are all being trafficked here to populate a dwindling country. Asia has two countries with over a billion people each, and we have a third of that; in consumer-driven economies, that is critical. Elites need people not just as workers, but consumers as well - of all things (especially housing and public education, to keep our government worker caste employed.

The third bill passed by the 2023 House & Senate: *

1) If you know, think, or even suspect that you are a ‘dreamer’ you have one year from 2023/07/04 to enroll in the USA Naturalization process. You then will have three years to complete the process.
2) If you do not enter the Naturalization process and are apprehended for any reason:
a) you will be deported to the country of your parents origin within one week of the apprehension,
b) any assets acquired by you will be sold and the money transferred to you less a 10% disposition fee,
c) any family you may have will have the choice of going with you or staying in the USA provided these individuals can prove themselves to be USA citizens as proscribed under current law.

So let it be written ...

* bills one and two have to do with cancellation of any GND laws and completion and arming of the southern wall.

If it is illegal, then the court had no basis for continuing the illegal program. It should instead give the government 30-90 to implement deportation against these 600+ thousand original people, plus the likely 100s of thousands additional that Obama, Trump, and Biden enrolled. Deport them all, plus deport their families. The judge, an honest and diligent one, would ask for a report at the end of that period spelling out the disposition of the people illegally entered into the program and illegally in the US—who was deported, who was now continuing to be illegally in the US, and who was reassigned into some other status that allowed them to stay in the US and how many of those have or don’t have work permits, taking jobs from Americans, taking housing from Americans, maybe getting government benefits costing taxpayers or taking from benefits that otherwise should have gone to US citizens.

There are a lot of children been born here to unwed mothers but the guberment supports them on welfare and keeps them uneducated-read non workers— so they have an excuse to bring in illegals.

I honestly don’t understand why any of these kids haven’t requested citizenship. If your parents bring you to the country at five years old, the minute you’re 18 you should put in your papers for citizenship. You certainly have the time requirement met. You must likely can speak English. You can probably pass the test. What is wrong with these 18-year-olds that they can’t simply fill out a form and become a citizen?
