Supreme Court won’t take up defamation case involving MyPillow’s Mike Lindell

WASHINGTON — The Supreme Court says it won’t intervene in a lawsuit in which Dominion Voting Systems accused MyPillow chief executive Mike Lindell of defamation for falsely accusing the company of rigging the 2020 presidential election against former President Donald Trump.

As is typical, the high court did not say anything Monday about the case in rejecting it among a host of others. Monday is the first day the high court is hearing arguments after taking a summer break.

Lindell is part of a case in which Dominion also accused Trump allies Sidney Powell and Rudy Giuliani of defamation for falsely claiming that the election was “stolen.” The Denver, Colorado-based Dominion has sought $1.3 billion in damages from the trio.

A lower court judge in August of last year declined to dismiss the case and instead said it could go forward. Lindell had appealed that determination, but a federal appeals court said his appeal was premature. The Supreme Court declined to take up that issue.

Powell and Giuliani, both lawyers who filed election challenges on Trump’s behalf, and Lindell, who was one of Trump’s most vocal public supporters, made various unproven claims about the voting machine company during news conferences, election rallies and on social media and television.

There was no widespread fraud in the election, which a range of election officials across the country, including Trump’s attorney general, William Barr, have confirmed. Republican governors in Arizona and Georgia, key battleground states crucial to Biden’s victory, also vouched for the integrity of the elections in their states. Dominion machines tabulated ballots in 28 states.

In September, a judge in Minnesota declined to dismiss a separate defamation lawsuit by a different voting machine maker, Smartmatic, against Lindell. Smartmatic’s machines were used only in Los Angeles County during the 2020 election.

That in itself is defamation. In what way can they prove that it’s a falsehood? The Arizona Audit is still outstanding, with over 57,000 votes in contention. The AG decided to sit on that, which is the major reason he will soon be looking for personal injury cases in greater Phoenix rather then being in government.

Doesn’t sound like a standing issue. Rather, the appellate court said they need to wait until the trial court phase of the case was over before they can proceed with an appeal.

I thought the Arizona audit was finished and findings presented to the Arizona Senate, complete with recommendations for criminal referrals which the Senate did, and recommendations to tighten the legislative code to prevent and prosecute future election crimes.

You get the impression that they are obligated to write this. Like they won't be invited to any parties anymore if they don't speak the sacred phrases. How many times have you read articles about "flat-earthers" where the journalist feels obligated to say "the unproven theory that the earth is flat"?

There are THOUSANDS of documented cases and the combined magnitude and effect of them collectively was well over what was required to steal the election.

They just keep making the same knee-jerk declarations “falsely accused” and “no fraud” no matter what the evidence shows.

It won’t ever get too far in court. Too vague and the billion dollar amount is absurd. The lower court only said dismissal would be premature.

Forget about defamation.

Take up the case of the illegal search and seizure of Mike Lindell’s home contrary to the 4th Amendment requirement for probable cause BEFORE such search or seizure.

Neither has been proven, but there is evidence to support both, and the former has more evidence.
