Judge overrules special master order for Trump to give 'final' objections on FBI search inventory

U.S. District Judge Aileen M. Cannon on Thursday overruled an order by Special Master Raymond Dearie that said former President Donald Trump needed to provide any "final" objections or disputes regarding the items seized by the FBI during its unprecedented raid on Mar-a-Lago last month.

Last week, Dearie asked the Trump team that by no later than Sept. 30 to provide a declaration of affidavit that includes a list of any specific items in the property inventory that they assert were not seized from the premises; a list of items that were seized but to which the description of the contents or the location of the item was incorrect; and a list and description of any item that Trump’s legal team asserts was seized but is not listed in the property receipt.

"This submission shall be plaintiff’s final opportunity to raise any factual dispute as to the completeness and accuracy of the Detailed property inventory," Dearie wrote in the filing last week.

Cannon, who appointed Dearie as special master, reviewed his order and on Thursday said there "shall be no separate requirement" for Trump "at this stage, prior to the review of the Seized Materials, to lodge ex ante final objections to the accuracy of Defendant’s Inventory, its descriptions, or its contents."

"The Court’s Appointment Order did not contemplate that obligation; Defendant since has complied with the requirement to attest to its now-revised inventory and the parties and the Special Master are situated to proceed forward with the process pending exchange of the actual materials," Cannon wrote.

Lol, if there’s one thing I have experience and knowledge in it’s attorney’s. Dearie hired Orenstein because the last thing in the world he wants to do, particularly at his age, is review 11,000 document, or 1,100, or 110 or 11..........well, maybe, he will look at 11.

In my experience, which is 50 years worth of almost non stop litigation (civil/environmental/developments/real estate and 2 divorces), 9 out of 10 attorneys pick up the fil on the way out the door to the courthouse. Most attorneys (not all) are lazy!

For all of us non-lawyers, what exactly does this mean? In plain English, please! Thank you in advance. I’m just a dumbass MSEE and Lawyer speak is not among my strengths. Not even close.

That's why Robert Mueller knew nothing about his so-called "report" when quizzed about it on Capitol Hill. I'm no lawyer, but it was obvious from the beginning that Mueller just picked up his paycheck, and had little or nothing to do with the actual investigation he was supposed to have been conducting. Weissman ran that show.

I believe he/she’s say the attorney doesn’t do the needed homework but just grabs the FILE (not fil… that was a typo) on the way to the courthouse, does a quick refresher review and then wings it in court.

IMHO, some are like that but some work long, long hours preparing. The good ones can be VERY expensive and bill for all those hours.

11,000 documents = 200,000 pages apparently.

Cannon’s oversight of senior Judge “Dreary” for acting outside the scope of her appointment of him as special master is something he is not he is probably accustomed to have to deal with.

I understand that Barry’s classified presidential documents are stored in a Hoffman Estated former furniture store. Trumps were locked up at Mara Lego.

I agree with your statement above. I once had an attorney in a one day jury trial having fairly serious heart disturbances during the trial. At one point, I threatened him that I would tell the judge if he didn’t stop. He kept going and despite all we won. So, as I said in my post, not ALL attorneys are LAZY but 51% are in my opinion based upon several thousand hours dealing with them and paying them over a 50 year timespan.

.........well, it means that many lawyers hate their profession (my son in law and x fiance being two that come to mind) and that many of the ones involved in general litigation simply cannot focus and concentrate on the FACTS of their client’s case BEFORE going to the courthouse. They often will bill you for, say, 10 hours when they only worked one. It’s a scourge on the profession.

Sounds like FIB has been talking to Special Master Raymond Dearie also appears they are in a big CYA rush.

How the election turn out may reveal many bad issues with them.
