Why President Trump Can Share Classified Information If He Wants

When the Washington Post reported on Monday that President Donald Trump had shared classified information with Russian officials during a meeting at the White House, the White House response was to deny that any military details had been shared that weren’t already known — even as the President attested on Twitter that he had the “absolute right” to share facts with foreign officials.

Whether or not the President did share information that others would want kept secret — a possibility that Russian media downplayed even as outlets like the New York Times continued to add details to the story, such as information about the Israeli sources of the intelligence — he’s basically correct that he could share such information if he wanted to.

The reason, says Timothy Naftali, Clinical Associate Professor of History and Public Service at New York University and former director of the Richard Nixon Presidential Library and Museum, goes all the way back to the Constitution and the basic structure of power in the United States.

“The president is the ultimate authorizing authority,” as he puts it.

Note the date of this TIME article: MAY 16, 2017. I wonder if the FBI scooped up a copy of this article in the Mar-a-Lago Raid.

A concise explanation of what’s going on can be found in this 1974 Indiana Law Journal article about executive power and national security, by Charles R. Nesson: “Technically any official has authority to declassify any information classified by people subordinate to him. Thus when the President speaks, whether to the nation, to a reporter in private, or to a friend over cocktails, he automatically declassifies as he goes. There is no procedure, no paperwork. The same is true for other officials so long as they do not stray from the pyramids of classified information which have been generated beneath them.”

I remember when Carter was about to lose his 2nd run for the presidency and it was revealed that he had gutted the military budget. To counter this he released, without consultation, information on the Stealth Bomber, that the Soviets knew nothing about. “See! We are pro-military!”
No problem for dem presidents to declassify stuff.

1) Get Trump

2) Take power away from POTUS and give it to the Intelligence Community

“The executive Power shall be vested in a President of the United States of America.”

These Communists need no excuse to persecute Trump.

They would arrest him for animal cruelty if he scolded the dog.

It’s not about classified materials.

They want him discredited and eliminated.

Need to ask... Isn’t all of this based on Biden revoking Pres Trump’s security clearance?

Personally, I don’t think anyone but former President’s should be able hold a clearance after they’re done and even then, it should only be for 4 years.

As for retired flag officers, SES folks, etc, there is absolutely NO reason for any of them to hold onto a clearance, of any kind. Those clearances are like lottery tickets for those folks. It gives companies and boards access to all sorts of information they wouldn’t otherwise be privy to.

The president can declassify anything he wants any time he wants.

There is no formal procedure required.

Several federal court cases have affirmed this. Which is why any of the breathless claims that President Trump kept classified material are laughable. He was the President. Him saying they are declassified, makes them declassified. Nobody gets any kind of veto over that power a president has. ALL executive branch authority flows from the president. The president is the only elected member of the Executive branch.

Sort of like the traitor Obama telling the Russian ambassador that he had one more election to win then he could be more flexible on our nuclear weapons,in other words selling us out!
Didn’t see the New York Times exposing the traitor or any of the other communist media

And this is why indictment is not a possibility because what ever Trump did as President, impeachment(which was done twice without conviction) is the only remedy available. Just sayin.

He like the Clintons, and their Chinese connections, won’t ever be brought to justice, as the MSM props them up whenever they can.

Of course they create the impression that things are turning on occasion but nothing ever happens. Think Benghazi....

And don’t forget in the 90’s Clinton declassified technology for ICBM’s when it was found that one of his friends had shared it with China, so they could launch his satellites. This kept Loral Space out of jail, big Clinton donors.

I wonder if it is possible for a human being to be aware of every bit of those "pyramids of classified information" in the present moment. Bill Barr said that automatic declassification is nonsense. Nesson and Barr both went to esteemed law schools. When something can be true and false simultaneously everything is true and false, the practice of "law" is doing what you can get away with, and it is impossible for a POTUS to do his job.

That may well be true. But I’m afraid that somewhere along the line a judge will be deciding.

But any case that applies to Trump while he is President, not in 2022. If there is no record of the declassification and no witnesses to his declaration what does a judge do?

I’m worried about that.
