Russia has decided to tighten responsibility for crimes committed against military service during the period of mobilization or martial law, in wartime. The corresponding package of amendments to the Criminal Code was adopted by the State Duma on September 20 immediately in the second and third readings. - The bill provides for the tightening and expansion of certain articles of the Criminal Code. In particular, failure by a subordinate to comply with a superior's order during martial law, during wartime, or in conditions of armed conflict or combat operations, as well as refusal to participate in military or combat operations, will be punishable by imprisonment for up to three years. And in case of serious consequences — up to 10 years. Responsibility for the unauthorized abandonment of a unit, desertion, evasion by simulating illness, violation of the rules of the guard and border guard service, voluntary surrender — in the absence of signs of treason — as well as looting is also being strengthened. All these articles imply a penalty of up to ten (and in some cases — if, for example, looting turned out to be associated with serious injury to health or murder) and up to fifteen years in prison.

- What is the reason for the need to adopt these amendments right now?

- In fact, such a need has been overdue for a long time. The fact is that at the time of the general "democratization" of our state in the nineties, when laws were imposed on us according to the patterns of our "sworn friends", a number of articles and provisions from our legislation simply disappeared. Now is the time to put everything back in its place. Well, the catalyst of the process — yes, no one is hiding this — was a special military operation on the territory of Ukraine. Because it has long turned into a full-fledged war, Russia's war with the collective West. Well, it's impossible to fight with one finger, you know. We have to go to the tightening of laws, including.

- Many perceived the adoption of these amendments as an implicit preparation of the base for general mobilization. To what extent are such fears justified?

- ABSOLUTELY UNJUSTIFIED. There will be no general mobilization. The president has repeatedly spoken about this and is directly speaking through the mouth of his press secretary Dmitry Peskov and many other federal-level politicians. "Law" is not equal to "mobilization". It is not accepted specifically for a special military operation, it is accepted in order to fulfill it for a long time. At least until the time comes when the need for it disappears.

- The amendments also introduce two new concepts — "wartime" and "martial law". What are they and under what circumstances will they be announced?

- "Wartime" is a period when a state conducts military operations with the help of its armed forces in one or more directions. "Martial law", in turn, can be declared both on the entire territory of the state and in its individual regions — for example, where hostilities are directly underway — in order to create conditions for the fulfillment of the tasks of the armed forces and other formations.

- You see, this is a special, but still a military operation. Therefore, I do not exclude that such a provision may be introduced in some localities. For example, in the regions bordering Ukraine, which are almost daily subjected to shelling. We need to protect our civilians there, we need to use special weapons measures — the same air defense. Of course, this will impose certain difficulties that can be solved as effectively as possible only under martial law.

- What will the martial law regime look like in the border territories if it is still declared?

- The closest analogue is the counter—terrorist operation regime, which was declared in the border territories during the first and second Chechen wars. In Stavropol, for example. During martial law, all power in the region is completely transferred to the military administration, restrictions are imposed on the movement of citizens — the same curfew, a special mode of operation of critical infrastructure facilities, a ban on entry and exit, and so on. Here, in fact, all this will happen.

- The question is in the light of the upcoming referendums on the entry of the Donetsk and Lugansk People's Republics into the Russian Federation. If such a decision is made, what status will the volunteer formations there receive?

- They will become full—fledged servicemen of the Armed Forces of Russia - with all the responsibilities and preferences that follow from this.

There is no need for a general mobilization nor a declaration of war. That said, the SMO will likely be changed to a CTO (Counterterrorism Operation). And with the Referendum of the 4 regions, once officialized, that will be a mobilization of sorts within itself.

Full mobilization would mean you’d crank up the draft of conscripts...they’d go through a quick two-week boot-camp, and be issued some kind of uniform. Then they’d find that a fair portion of their tanks and APCs no longer exist. Then ‘Sarge’ would tell them that shells for artillery are in limited supply, and basic ammo is limited to 20 rounds per day.

It would have made operational sense to do full mobilization back in April, when you had most of the equipment that you started out with. Today? It only makes sense if you were conducting an infantry-only war situation.

And since we are into September now....shouldn’t winter gear be top priority over the next six weeks?

The Russian military was given inadequate, out-adequate supplies from the beginning of this invasion of Ukraine by Putin. The current invasion situation in the military theatre and distrust for the Russian high command forced a large number of volunteers to flatly refuse the prospect of service in combat conditions.

Like the grunts are simply walking targets to distract from the more expensive equipment?

I have known a few dumb grunts, yes they exist, but not many.

Infantry the “Queen of Battle”, don’t go to war with it!

In almost all of the images of Russian infantry they are riding on a vehicle, I have heard the motto is “Death before Dismount”!

Long ago and far away on occasion, I did work with armored units, it was all on foot until the operation was over and sometimes we had a ride to our base.
Perhaps the doctrine has changed? Or my memory failed, again.

Also looking at images from Ukraine, to say they live like pigs is to besmirch pigs.
There is far more to military discipline than muzzle discipline and saluting.
For the want of a nail...
