I went to SDSU and follow their teams. The guy was a great punter in college. He was likely going to have a long NFL career. Not anymore.

I guess you could call a rape a screw, right? I assume you are male. If a person drugged you and mauled you including injuries to your sexual parts, would it be a rape? Or a screw? Think carefully.

You make an awful lot of assumptions there, with very few facts. Yes, rape is a horrible thing. We don't know what this was.

One interesting thing is - it appears the Bills new about the case/charges, but signed him anyway, and cut their veteran punter.

the Bills owners (Kim and Terry Pegula) and the team coach are extremely cautious people, will avoid any public controversy whatsoever. A few years ago, they fired a President of the organization for having a consensual sexual relationship with another staff in the office (he was married though).

One wonders how much they actually knew. I suppose they weren’t aware a civil case would come - but perhaps should have - since they literally just signed the punter to a $$ multi-million contract.

Just because a woman is drunk, even very drunk, does not mean that she can’t consent to sex. Reading between the lines....she went to the police and they found insufficient evidence to even charge and now her lawyers are doing a hit-job on a wealthy NFL player.

It wasn’t what you say.

The age of consent is 16 in over 20 states, 17 in a few others.

A 17-year-old woman is responsible for her actions according to the generally accepted law.

Completely and utterly wrong, in a legal sense. If the woman is drunk the consent is not considered valid. This is law 101. It may well be that she thought better of it the next day. But from a legal point of view, she was incapable of forming consent. The fact that this is a civil and not criminal case raises a few red flags though.

You have no evidence there was a rape.

All the “participants” may have been drunk.

The age of consent in most of the US states is 17 or 16.

A false accusation of rape can destroy lives.

You don’t know if the men were drunk and only have her word that she was.

As a practical matter, that tends not to make a difference. But frankly, a prosecutor would be disinclined to pursue such a case. The water is far too muddy. Perhaps that’s why it’s being pursued civilly.

The thing is a guy could be screwing 17-year-old girl 5 feet on one side of a state border and be prosecuted and be screwing the same girl on the other side of that border and suffer nothing.

The UNDERAGE 17 year old said she was given alcohol and felt there was something else in a drink she was given. She was in and out of consciousness and certainly not able to give consent.

Sounds like you are saying that raping children is A-OK in your book.

As a former prosecutor and now a defense attorney with 30 years of experience, including handling 200 plus sex offense cases, I can assure you that being drunk does not vitiate consent (although I can’t speak for California). In fact, in drunk driving cases, suspects “consent” to do field sobriety tests; they consent to waive Miranda rights; they sign off on forms with microscopic text and consent to take breathalizer tests—and in all of these instances a law enforcement officer is judging the “consenting person” to be drunk.

Respectfully, you are incorrect. However, if a woman is passed out or completely incoherent, that would be a different story.
