They can’t be retrying him if it was a criminal case - that’s double jeopardy and blatantly unconstitutional.
Bringing NEW charges is a new low, however.

Cuomo didn’t just send them back.
In March of 2020, Trump got CMS to change its regs allowing residential care facilities the ability to refuse to take back sick CoupFlu patients.
Cuomo ordered them sent back in May.
But the facilities did NOT have to comply thanks to the change in federal regs.
But most NYS facilities complied anyway.
Just why was that?
Wanna bet Albany threatened owners and administrators with inspections and increased scrutiny?
Our legislature was, and still is, just fine with whatever Cuomo ordered done.
The legislature knows right where to look to get to the bottom if it.
But they haven’t and won’t
Cool. So when Trump gets back into office, his DOJ will go after anyone this decrepit tyrant grants clemency to.
Disregard of clemency order… Roger Stone’s clemency order was seized from Mar-A-Lago. I don’t know any details of Esformes, but it seems the DOJ acts as if anything done by Trump is not valid. It as if Trump was never the legitimate President. That also means we are not legitimate citizens and are votes never counted. There is massive projection going on here by the Biden Administration, which only existed because of massive election fraud. They are not legitimate.
