A Lehigh County PA man was charged Friday in the Jan. 6 insurrectionist riot in Washington after making statements to the FBI that he entered the Capitol.
Samuel Fontanez Rodriguez, 33, of Emmaus, PA faces a charge of knowingly entering or remaining in any restricted building or grounds without lawful authority.
Fontanez Rodriguez allegedly told the FBI he entered the Capital “for a short period of time” and “was exposed to tear gas and smoke bombs” during the siege that occurred as Congress and Mike Pence were working to certify the 2020 vote for president.
The riot, now the focus of hearings, resulted in 725 arrests by the first anniversary of the incident. Since then, a total of 892 cases have been opened, including Fontanez Rodriguez’s — or 167 since Jan. 6 as the investigation continue.
Department of Justice records show 68 of the arrests occurred in Pennsylvania.

Another Lehigh Valley resident charged in the riot, Jackson Kostolsky, identified Fontanez Rodriguez as the figure seen in photos on Kostolsky’s cellphone showing Kostolsky lying prone with Fontanez Rodriguez’s knee near his neck.
Kostolsky, 32, of Whitehall Township, is identified in photos from the riot wearing a leopard-print vest. He pleaded guilty to charges last September and was sentenced in January to three years’ probation, including 30 days of house arrest, plus $500 restitution.
The Justice Department also watched as each of the eight sessions revealed information that could figure into a potential prosecution of the ex-president.

Let the DOJ prove their case that he was not invited in by the friendly guards. Once inside with permission, prove he was given notice it was time to leave and he refused to leave. Of course what he has going against him is the DC jury pool - all demonkraps. I would like to see this go all the way to the SCt of unfair jury - add political party to biased jury, similar to race - convicted on his political beliefs (1st A) not on the facts and law.
