INDIANAPOLIS (AP) — An Indianapolis doctor who performed an abortion on a 10-year-old rape victim from Ohio took the first step Tuesday toward suing Indiana’s attorney general for defamation.
Dr. Caitlin Bernard, an Indianapolis obstetrician-gynecologist who gave the girl a medication-induced abortion on June 30, filed a tort claim notice over what she says are false statements that Attorney General Todd Rokita has made about her and her work.
Bernard’s lawyer, Kathleen DeLaney, filed the “tort claim notice” against Rokita just days after she sent a cease and desist letter.
After the news of the 10-year-old’s abortion broke, Rokita told Fox he would investigate whether Bernard violated child abuse notification or abortion reporting laws. He also said his office would look into whether anything Bernard said to the Indianapolis Star about the girl’s case violated federal medical privacy laws. Rokita offered no specific allegations of wrongdoing.

No, the Indiana AG's going on national television and asserting as fact that the doctor in question "has a history of not reporting" -- which would be a crime if true -- is what is actually being alleged as the defamatory statement. The doctor's position is that she's never failed to report as the Indiana AG asserted, nor is there any documented evidence of his claim.
Believe me, if you rely solely on news reports, much less snippets of news reports, to explain what is supposedly going on in a court case, you'll almost always have it wrong.
This isn’t battery, or B&E. The DA needs to check if the paperwork was filed for the little girl to report possible rape.

She made herself a public figure when she took the story to the news media, so she already has a huge hurdle to overcome to make a defamation claim.
Then there’s the fact that she is trying to sue a sitting Attorney General who has the protection of sovereign immunity, another huge hurdle to overcome.
I don’t think she’ll be filing any suit. But I guess if you are willing to spend enough money, you can find some lawyer willing to take it.
