Well, SCOTUS certainly did that with respect to carbon emissions, but Butt-Head is trying to ideologically restrict or close the Permian Basin based on ozone pollution, which is a long-established regulatory function of the federal government. I’m not sure the SCOTUS ruling applies to that one.

It may be long-established, but is it legal? The eco-fascist regulatory agencies are well-known for making sh*t up that exceed congressional rule-making authority. Besides, it’s illegal for agencies to write law. Only congress may pass legislation.
