The Supreme Court handed President Joe Biden a victory Thursday, ruling that he can shut down a Trump administration program designed to restrict immigration at the southern border.
The court said in a 5-4 ruling that the Biden administration acted properly in seeking to end the "Remain in Mexico" policy, formally known as the Migrant Protection Protocols. It required people seeking asylum at the southern border, mainly from Central America, to wait in Mexico while their claims were decided.

The cost and the Feds won’t allow them to build it on Federal land which rides along the entire border.
So the States have to build it in a ways, on private property.
Which is a whole other issue.
Until Texas and other border states start sending serious amounts of them northeast it won’t change.

This is a disappointing ruling. But you’re right.
The root problem is that presidents have exercised too much power with executive orders. Presidents are supposed to carry out Congress’s wishes. Issuing executive orders is one way to do that.
Presidents are not supposed to use executive orders to make their own policies.
It’s not an easy call.
If you have let’s say a medium sized ranch of 100 acres.
Are you willing to give up 1/4 of it? 25 acres?

Haven’t read the opinion yet, but IIRC, the previous issue was that Biden hadn’t followed the Administrative Procedures Act, which is basically a time delay for notice and comment.
IMO, that entire APA thing elevates the administrative state over the elected institutions. The rock bottom responsible institution here is Congress. Congress is not demanding that the border be protected, and is not rquiring POTUS to defend the country against invasion.
In other words, what is going on is a silence is approval invasion. Congress approves of the situation at the border. This is a decades old issue, Reagan and before. when the issue is brough up in Congress, it is for the purpose of granting amnesty.
It certainly isn’t the court’s fault that the border isn’t enforced, although a few court decisions have provided legal protection for invaders and also have acted to encourage invasion (entitled to public education, Plyler v. Doe).

That is my understanding.
