Murkowski vows to work on legislation in response to abortion ruling (but first, a nice recess!)

Republican Sen. Lisa Murkowski (Alaska) announced Friday that she would prioritize legislation permitting abortion across the country following the Dobbs v. Jackson Supreme Court decision that overturned Roe v. Wade.

“In the wake of this ruling, it is up to Congress to respond,” wrote Murkowski, vowing that she would continue “to work with a broader group to restore women’s freedom to control their own health decisions wherever they live.”

She added: “Legislation to accomplish that must be a priority.”

Murkowski recounted that she had introduced legislation earlier this year “to protect women’s reproductive rights as provided in Roe,” namely the Reproductive Choice Act.

A press release explained that the Reproductive Choice Act would “codify the standards set in Roe and Casey and assure they continue to be the law of the land.”

“Senator Murkowski supports women’s reproductive freedoms, including the right to an abortion up to fetal viability,” the statement reads.

Fetal viability, the gestational age at which a fetus is able to survive outside of the womb, in the U.S. is currently considered to be 24 weeks. The earliest a baby has been born is at 21 weeks gestation, a record set at The University of Alabama at Birmingham Hospital.

Women have all kinds of reproductive rights.

There are tons of contraceptive methods out there if a woman doesn’t want to get pregnant. Aside from simply not sleeping around wantonly.

They do not have to kill a baby they didn’t want.

Anything Congress comes up with is likely unconstitutional. They don’t have that power to federally regulate, unless they want to try and call it interstate commerce.

The 'usual suspects' know that the filibuster is the only thing that gives them a way of halting legislation they don't like. They're not going to give that up, even if they take the Senate back in the fall. Especially not for something that gives Biden a win.

I think so, in principle, but the government is unprincipled. I expect SCTOUS would uphold federal legislation on this.

That said, a mental check I do to get a sense is to postulate extreme regulation and see if that would be a federal power, and if not, why not.

Hypothesize a total ban, no exceptions. Then the opposite. make it illegal for a state to regulate abortion. There are areas that states may not regulate, for example no state may make a machine gun legal (I know that's a simplfcation of the actual law) because the feds have made it illegal.

Women can just travel to baby-murdering states to murder their babies. Problem solved. We don’t need a uniform baby-murder law across the land. Let the STATES decide.
