The Washington state Supreme Court on Thursday ruled that a person’s race, and law enforcement’s long history of discrimination against people of color, should be taken into account when determining the legality of police seizures.
The court also clarified state law to say that police has seized a person if an objective observer — who is aware that discrimination and biases “have resulted in disproportionate police contacts, investigative seizures, and uses of force against Black, Indigenous, and other People of Color” — would conclude that the person was not free to leave or refuse a request.
“Today, we formally recognize what has always been true: In interactions with law enforcement, race and ethnicity matter,” Justice Mary Yu wrote for the unanimous court. “Therefore, courts must consider the race and ethnicity of the allegedly seized person as part of the totality of the circumstances when deciding whether there was a seizure.”
The case concerns Palla Sum, a person of color, who was sleeping in his car in Tacoma, when police came upon him. An officer ran his plates and determined the car had not been reported stolen.
The officer knocked on the window, asked Sum questions and asked him for identification.
Sum gave a false name and the officer went back to his cruiser to check records. Sum then drove off, crashed into a front lawn and was caught as he attempted to run away.
He was subsequently charged with making a false statement, attempting to flee police and unlawful possession of a firearm, after a gun was found in his car.
But Sum argued his statements to police should be inadmissible, because he was “unlawfully seized” by police after the officer asked for his identification and said that had been car thefts in the area.

Race makes zero sense. A crime is a crime. If a vehicle is going 87 MPH what has race got to do except the speed of the driver/car. Any theft or crime responded to police should go by any info they got-not stop because of race.
This article, as well as Coulter’s column highlight the single accepted false assumption that is at the root of our racial dystopia.
The false assumption is that “on AVERAGE all races are the same”. Something that is shown to be patently false to anyone willing to open his eyes.
It is that false assumption that leads to the moronic and dangerous rulings such as the one made by this court.
The irony of this is that instead of fixing the problem, it will only make it worse. Now more blacks are going to feel that they can misbehave WITH even fewer consequences.
What’s discouraging and depressing is that these anti-white rulings are made by whites - whites that can never self-flagellate themselves enough to atone for their ancestors past sins.
I have not seen any formal documentation of that claim.
In the late 70’s, early 80’s such a charge was intended to discredit a political opponent. She had many enemies.
Fair-minded people will give her the benefit of the doubt about her private life when considering her political record. She can not defend herself now, and there is still an injunction against false witness.
Every society in human society had stupid and false beliefs—laughed at by future generations.
We have lots and lots of them—and of course they all lead to terrible public policy and doubling down on stupidity.
Homo Sapiens loves false beliefs that allow them to feel good about themselves.

An unintended consequences of this type of 'favoritism' will be MORE deaths in the black community.
Example: A black couple out 'on the town' drinks less when they fear getting a DUI But now, knowing they have the same privilege as Nancy Pelosi's drunk husband - they get in their car a little tipsy and kill a young black couple returning from a dinner out... Or they run over some kids crossing the street.
The black community must be so proud of the 'protection' white liberal elites' give them...

A school district in Oregon was exposed by a mother on Lars Larson’s radio show having provided weekly treats to minority children and refusing said treats to whites. Her daughter came home crying one day and exposed the practice...about which there is not a single byte of data anywhere on the web.
