Liz Cheney’s powerful remarks at Thursday night’s Jan. 6 congressional hearing on the insurrection at the U.S. Capitol — which sounded a lot like a lawyer’s opening statement at a criminal trial — have renewed a debate in legal circles about whether the Justice Department could and should prosecute Donald Trump.
With a growing body of evidence that Cheney and others say points to criminal acts involving Trump’s efforts to overturn the 2020 election, Attorney General Merrick Garland may ultimately be faced with an excruciatingly difficult decision about whether prosecuting a former president is in the national interest.
A person familiar with the matter told NBC News there have been conversations inside the Justice Department about the far-reaching implications of pursuing a case against the former president, should it come to that. So far, no public evidence has surfaced that Trump has become a criminal target.
Filing criminal charges against Trump in connection with his efforts to overturn the election “will very likely spark civil unrest, and maybe even civil war,” said Barbara McQuade, an NBC legal analyst and a former U.S. attorney.
But, she said, “I think not charging is even worse, because not charging means you failed to hold someone criminally accountable who tried to subvert our democracy.”
The Justice Department by tradition makes criminal charging decisions independent of the president, but in cases that implicate, American diplomacy or national security, the executive branch can and does weigh in. Biden would have the legal authority to make the final decision about whether to prosecute, but experts are divided on whether he should get involved.

as we saw last week in the sussman trial, the scary thing about DOJ filing charges against trump is that the jurisdiction would fall right in the middle of the DC swap courts.
This is mostly just talk. They have nothing to get Trump with. The stuff they are using on their TV soap opera is manipulated and made up cherry pickings of testimony of people forced to sit and get interrogated by the actual perps of Jan 6th Congress and FBI staged attack.
If they actually had real information that Trump did anything, it would have been used by now and they would no longer need to pay any attention to him.
Everything they do is to make it impossible for him to run again and make the people who would support him run away from the support because the harassment ruins their lives.
It would guarantee a 2022 Red Great Flood, beyond a Red Tsunami.

That’s one part of it. The other is that every other attempt to prevent Trump from holding office (other than Biden “winning”) has failed. They now need a legal pretext to make him ineligible.
And it’s because of their demonic hatred for him. He exposed their corruption like no one else. They know that if he can run again, he has a good chance of winning. If that occurs, he may just take a wrecking ball to the corrupt institutions which run cover for them (FBI, CIA, administrative state...) and end the gravy train.
They can’t, that would entail discovery. They can’t let that happen.
