Geico may be on the hook for a $5.2 million legal settlement after a woman alleged she contracted a sexually transmitted disease in a car insured by the company.

A Missouri court on Tuesday upheld a judgment that awarded the money to the woman, who is referred to "M.O." in court documents. M.O. claimed she caught the human papillomavirus (HPV) from having sex in 2017 with a male partner in his 2014 Hyundai Genesis, which was covered by Geico, according to a 2021 complaint.

The woman, who learned she was infected with HPV in 2018, claimed the man knew he had HPV but failed to inform her, leaving her with "past and future medical expenses" and "mental and physical pain and suffering."

Just... I can't believe the appeals court sided with her on this. What's next? Child support as well?

Dumb question: Who has an auto insurance policy with a liability limit high enough to pay a $5.2 million claim?

I'll have to read the details of the story, but this sounds like it has to be some kind of umbrella liability coverage tied to an auto insurance policy.

“Just... I can’t believe the appeals court sided with her on this.”

The problem is a woman or child is “injured” and directly in front of the jury. The other side is a faceless “rich” corporation with a smart-ass sarcastic lawyer representing them. How heartless can a juror be? Afterall, no one is injured if this faceless corporation helps out. The injured are after all poor, innocent, helpless people. There really is no defense against a jury intent on helping these poor people. Now, if the jury had to pay...different story. They complainants are evil vampires who need to suck it up and just go away.

Until very recently, Michigan had unlimited Medical liability on car insurance.

There was no jury here. The appellate court made a ruling in a case where Geico was challenging the result of an arbitration proceeding.

Ironically, major corporations like Geico began requiring their customers to waive their rights in civil court and agree to abide by arbitration decisions for the reasons you describe.

“Now, if the jury had to pay...”

General, ... they will pay ... when their premiums go up and policy coverage is updated to exclude this type of behavior.

Maybe trying to set a precedent for making gun manufacturers liable for gun deaths, hmmm?

That’s part of it yes, but the jury also should think about the rates they pay and understand this will cause a flurry of copycat claims now.

What about all the people who get shot in a car, are they now able to claim a death benefit from the insurance? Knocked up in the back seat, medical bills for the delivery?

That the appeals court didn’t knock the amount down is mind boggling also, this is so much worse than the hot coffee McDonald’s case IMHO.

GEICO offers Umbrella Insurance.

That’s outlandish, but even in that scenario I can’t see how an STD would ever amount to a $5.2 million claim.

If any party is “at fault” it would be her for agreeing to have casual sex in some man’s rented car.

"GEICO offers Umbrella Insurance"

Highly unlikely that a guy with an STD tapping women in his 2014 Hyundai Genesis has a 5 million dollar umbrella policy.

Speak of suing gun manufacturers, maybe we could get Glock, or SIG to drop government contracts if they get sued every time a federal agent or local cop wastes a homeowner’s dog.

And each day I think that respect for the law cannot go lower. Silly me. Given this silliness and the crap going on with the woke folks, etc. the “law” will soon learn that it is only obeyed if it is respected by the majority. That exists no longer.
