A 61-year-old man has been charged with felony hate crimes after he allegedly both physically and verbally assaulted a female employee outside a phone store in Cupertino.
Santa Clara County District Attorney Jeff Rosen announced that a variety of charges have been filed against Clifford Stewart in the June 1st incident.
Stewart faces assault with force likely to produce great bodily injury, hate crimes, vandalism and threat against a police officer charges at his arraignment Friday afternoon.
Authorities said Stewart removed a T-Mobile sign from the walkway leading to the store located on Stevens Creek Boulevard and tossed it into the street.
A 38-year-old Hispanic T-Mobile employee witnessed the crime as did her co-worker, a 33-year-old Asian man.
New bill introduced to extend operating hours for bars until 4 a.m. When they left the store to retrieve the sign, Stewart immediately reacted by yelling to both of them "(expletive) Chinese, you don't belong here" and "stupid Mexicans."
When the female employee told Stewart she was going to call the police, he kicked her in the stomach and punched her in the face so violently that she temporarily lost sight in her left eye.
She was later transported to Stanford Hospital for treatment. The extent of her injuries remains unknown at this time.
"Hate crimes send an ugly and ignorant message to our community that certain people are not welcome here," Rosen said in a news release. "My response is that I will do everything in my power to hold criminal racists accountable in court. Hate is not welcome here."
When a sheriff's deputy arrived on scene and arrested him, Clifford Stewart threatened to kill the deputy and said to him: "All you piece of (expletive deleted) people sneak into this country, have a baby, and get a free apartment."

A crime is a crime. If the guy were anything other than white, the word would not apply.

At first I thought “Hating T-Mobile is a crime?” I was rather sympathetic to his point of view.
Then the last line cleared things up.
Oddly, I’ve never heard of Jeff Rosen charging anyone with a hate crime for making a racist statement in any language other then English.
In the Santa Clara valley, I routinely heard people saying despicable things about other people in Spanish; if I understood Mandarin, I suspect I’d hear tons of insults.
Funny how that works. You can only get an additional charge if you say something bad in English.

Extending bar hours seems like an odd way to fight hate crimes. But Iโm not a California legislator, so what do I know?

It a white guy punches a black guy without a good reason (self defense,etc) I could absolutely vote guilty provided the evidence against the defendant was sufficient. But I wouldn't care *why* he did so.Maybe he was having a bad day.Maybe he had just been fired.maybe he didn't like black people.The only thing that matters to me is the black guy was assaulted without justification.
IMO every single "hate crime" law on the books is unconstitutional...it violates "equal protectection".
The Constitution went at the 2020 election. The Coup that the Republican Part and Democrat Party executed to replace President Trump with Lying Joe Biden took care of it.

Hate crimes are also a violation of Double Jeopardy. Charged twice for same crime.
T-Mobile is weird. They must be the provider for Obama phones, because I stopped into one the other day looking for repairs to a tablet that I had dropped (they claimed to do repairs). But I saw out front one homeless person that I know, a bunch of bicycles (their means of transport) and inside a whole line of people who were either wandering druggies that I have seen on the streets here or people who had 100% “government income.” Not all black, btw.
I left because I knew my problem was outside of their scope...and because the two girls working behind the counter had bulletproof shields over their stations.
